Differance between Advocate and Lawyer

Dear sir/Madam

Please tell me the diffarance between Advocate and Lawyer.
who will file the case in court? and issues notice?

Advocate and Lawyer one and the same. Both can issue legal notice and can file a case. Some times advocates call as lawyers and vice-versa

Advocates are that who are enrolled in the roll of Bar Council. The advocates have power to file a case in the court of law.
Lawyers are that who have a degree of law but not in the roll of bar council.

An advocate is a lawyer but a lawyer may not be an advocate unless enrolled in bar council.

A lawyer may file a case in the court but not on others behalf.

A person should be enrolled as an "advocate" with the Bar Council in order to practice law. Any law graduate i.e. a "lawyer" can enroll himself/herself as an advocate

Advocate is a statutory term. Lawyer is a general term used by common man. Though in general, the word Lawyer is more popular than Advocate while addressing to or talking about an Advocate, but it is not formal or legal designation. Advocates Act uses the word Advocate for those who are enrolled in bar council.

Some times Law teachers and other legal experts and jurists who are not an advocate, are also called a Lawyer.

Only Advocate is authorized to file a case before the Law courts.

As per the advocates Act 1961

Section 2. Definitions.

1[(1)] In this Act, unless the context otherwise requires,-


(a) "advocate" means an advocate entered in any roll under the provisions of this Act;

(i) "legal practitioner" means an advocate 6[or vakil] of any High Court, a pleader mukhtar or revenue agent;


29. Advocates to be the only recognised class of persons entitled to practice law.

Subject to the provisions of this Act and any rules made thereunder, there shall, as from the appointed day, be only one class of persons entitled to practise the profession of law, namely, advocates.

But the issue is can any advocate who has enrolled in the Bar Council can relinquish and become lawyer for the same of employment other than legal profession? Experts to ponder over this point.
