Delayed payment of pension - reg.

Respected Learned Experts, Due to pending judicial proceedings, I have been sanctioned with provisional pension under Rule 69 of CCS (Pension) Rules 1972 in Jan 2020 i.e., after 3 years of of my date of retirement. I had filed my pension papers to my department in 2017 itself. I had filed a case before CAT claiming interest for the delayed payment of provisional payment. As I am appearing as Party In-person, I pray the Hon'ble Members to share any of the circulars/OM issued by the Department of Personnel and Training in connection with the time limit to sanction pension to under CCS Rule 1972. You already filed a case in CAT. I lightly remember that the HC/SC court passed orders that provisional pension shall be sanctioned within 6 months from retirement in a case. Sorry but I forgot it.

Respected Learned Expert Shri KAVK Satyanarayana, the case filed before the CAT was disposed off directing the department to pass speaking order on my representation. Thereafter, my department sanctioned provisional pension as per Rule 69 of CCS Pension Rules, 1972, however, turned down my request to release interest thereon on delayed payment of pension. I had filed a fresh case before the CAT claiming for interest on delayed payment of pension. Hence I am in need of any rule provision/OM/circulars prescribing any time limit for payment of pension. Thank you very much sir for your timely response.

I think there is no rule to claim interest on the Provisional pension.

You can represent to the higher authorities thru public grievance portal. But pension being provisonal and full penson not granted, your prayer for interest may be denied. But take a chance.
