Cheque bounce Sec 138 INA

Dear Sir,
A party lives in DELHI & has OFFICE there gave me a cheque to which I presented in bank at FARIDABAD which got bounced. I sent legal notice to party from FARIDABAD as MY RESIDENCE IS AT Faridabad . Now, I want to file case in court.

Will the case be filed at FARIDABAD court or DELHI court.

I made payment to party from my FARIDABAD BANK ACCOUNT by cheque.

You may file the case at Faridabad as you are a resident of that place. You should have received payment at your Faridabad bank and therefore jurisdiction is at Faridabad.

Part of cause of action has also arisen in Faridabad so file your complaint there.

Mr. Anonymous,
There are 4 competent jurisdiction to file cheque bounce cases. 1. Drawee address, 2. Drawee bank address, 3. Drawer's address and 4. Drawer's bank address. In your case you are the drawee of the cheque. your and your bank address comes at Faridabad, so you can file the case at Faridabad Court
