Chargesheet forgery

Victim of false 498a.

The Inspector has forged the signature of the previous retired Inspector on the chargesheet.

Two of the witnesses are ready to admit that they never gave the crpc 161 statements that has been placed on record and signed by the Inspector.

When and how can I take action against the Inspector under IPC? I filed a complaint to senior officials but no action has been taken.

Can I file a private complaint now itself to the Magistrate or do I need to wait till evidence?

If u have witnesses then immediately file private complaint lapse of time will weaken ur case and witness may refuse to help for xyz reason

You need not to wait for the outcome of the criminal case pending against you rather initiate action against such official. The signature can be got tallied with the signature of the retired officer.

Agreeing with Mr Makkar I would add that after few years the evidence of retired Inspector may not be so easy.

Any way the retired officer will be coming for evidence and forgary can be prove din cross-examination and then you can proceed one he denied his signature before court.

If you are able to prove forgary of signature then apart from 420 many sections of IPC would get operated.

Signature forgery can also be proved by Hand writing experts.

First the author has to deny his signature then court can get forensic test.

However if the retired inspector denied his signature before court, this will be a sufficient material for initiation of Disciplinary Action against the Io who produced such signature before court.
