Without perusing the covenants in the deed it is difficult to advise, seek services of a local lawyer.

it appears that builder has not made full payment to owner of the property as per the development agreement .

the agreement must be containing provision that in case builder fails to make payment on time he shall be liable to pay with interest.

in addtion there must be a bank guarantee etc given by builder which can be encahsed on account of failure of the builder to make payment on time

consult a local lawyer .
