Can my wife claim on my property, which will be against my will

(Querist) 18 April 2012 This query is : Resolved 
My Wife is seperated from me since 11 months. I wish to GIFT all my propery(LIC, Term insurance 20 of lakh) to my father or siter. I 'm going to WILL for the same.

After my certain death( Normal / suspious)

Can my wife claim on my propery which I have already GIFT'ed to father, mother or Sister?

no chance, but if she file a maintenance case that time you will provide.

if your wife is separated from you for 11 months be careful . be in touch with her and try to resolve issues amicably .

you can gift your property to your relatives as you desire . if you have gifted property and duly accepted by donee your wife cnanot make claim on it

I have 20 Lakhs Term insurance. Nominee is my mother. But incase after my death. Can my insurance company gave benifit to my mother or to my wife ?

Nominee is only just like a trustee who has only right to withdraw the money and distribute it to all legal heirs. In case of your death both mother and wife as right to take their share as class 1 legal heir.

If you do not execute any Will then your wife would get half share of your all properties.

Your wife cannot claim but I do suggest, dont go on that line. A time may come when you and your wife shall be one but the person in whose favour you intend to will out or gift out your property shall not be yours and you shall have to repent on that day.
