Cadre Controlling Authority of Practising Advocates

Querist : Anonymous (Querist) 05 March 2011 This query is : Resolved
Is there any cadre controlling authority of practising advocates ? Please guide me quoting necessary law including Judgement Law.
Advocate. Arunagiri (Expert) 05 March 2011
Bar Council of India is the controlling authority of practicing advocates. Please refer the Advocates Act 1961.
Querist : Anonymous (Querist) 05 March 2011
Bar Council Of India is the apex authority, where as the State Bar Councils are the licencing authorities.Whether any provision under the Advocate Act or any other law showing any cadre of Advocate and those are directly controlled by the Bar Councils.

I agree with Arunagiri.

Mr Dhingra and Mr. Arunagiri,
Please quote the relevent provision of the Advocates Act. Please do not write superfluous answer which will mislead me.
Advocate. Arunagiri (Expert) 06 March 2011
You can go through the Advocates Act and come back. If you say the reply is superfluous answer which will mislead you, Other experts are open to answer your query.

If you want a reply, you have to narrow down your query. If you are a legal expert I would have given more details. For a common man the reply is more than enough.

Please don't pass unhealthy and unwanted comments on the reply.

Dear Anonymous,

I feel, if you really know that you are being misled, you are petty well supposed to know the required information and you would not have come forward with such a question you posted for opinion of the experts, when you already know that yourself.

If you know that we are misleading you, you are welcome to correct us quoting the relevant ruling for our information.

I request you to please do that to enhance the knowledge of other community members also, besides us.

Mr Dhingra and Mr. Arunagiri,
Do not be annoyed. I will extremely grateful ,if you will provide me the relevent portion of Advocates Act. I have gone through the Advocates Act and BCI Rules. I did not find there anything about the CADRE OF ADVOCATES except the two terms Advocates and Senior Advocates .Furthermore, the BCI is not the only authority to declare an advocate as Senior Advocate.I need urgently Whether there is any CADRE CONTROLLING AUTHORITY . I think this query is narrowed down.Again, I will be extremely grateful, If I receive answer from both of you or from any other experts.

Dear Anonymous,
I have been watching this thread from sidelines right from the beginning.
I believe that you are requiring the answer not for academic sake but to solve certain problem immediately at hand.

Please state the problem that is nagging you. So that, one can provide the answer.

As far as 'Practising Advocates' are concerned they are professionals and certainly not any 'Cadre'. Therefore the question of any Cadre Controlling Authority does not at all arise in the first place.

Bar Council of India and the Respective State Bar Councils are only regulatory bodies of such 'Practising Advocates'.

Dear Mr. Ramachandran,
It is definitely to solve a problem. The problem is that I have gone through an advertisement for recruitment of certain post. The eligibility criteria is person having eligibility for District Judge. But the application must be channalised through the cadre controlling authority. Going through the advertisement I approached the secretary of the State Bar council to forward his application . But the secretary verbaly refused to do so.Then I approached the Dist.Judge on the ground that the advocates are the officers of the court. The Dist. Judge also refused to forward the application on the plea that he is not the cadre controlling Authrities. What I shall do ,please advise me.
