class i legal heir not coming forward hence can class ii legal heir proceed for claiming LA ? citation sent to class I legal heir received by him but not responded by him. testamentary dept says class II cant proceed in such case. even after several telephonic talks reminders , personal visits class I heir maintains that he is nor interested in the property nor giving his noc or anything in writing . can we request the court to send citation again, to send summons letter or something like that or give newspaper ad? if court declines to do anything like that and or refuses to take any sue motto action, what are remidies available to us ?

Hello,
I would like to know what are our options for the below matter.
Adjacent to our apartment compound wall, a factory has come up which is building iron frames and grills. It started small as a storehouse but now it has become big factory with many workers and different kinds of jobs. From 6:30 a.m to 6:30 pm in the day, they cut and polish iron with machines and also keep beating metals as part of their job. The noise is intolerable. It is unbearable not only to the old, ill and very young but also to strong healthy adults.
The owner of the factory is a real estate person, who owns many land plots and has built many apartments in the area. Our apartment was in fact built and sold to us by him.
Under such circumstances, what options do we have?
Please advise.

We are the Claimants in an Arbitration. Respondents have been under unauthorized possession of our very prime property since 2000(entered land under license from 1997-2000). We keep getting an extention from the court every three months to finish the arbitration but the Arbitrator and the Respondent are in no hurry to finish the arbitration as they have nothing to lose. They refuse to comply with any directions of the Arbitrator, even refuse to pay the Arbitrator and yet the Arbitrator says that he is POWERLESS to do anything coercive or even pass a punitive order since they won't pay up.Plus, the Arbitrator can't even pass an order directing an arrest warrant.
After 3 years of Arbitration, the Respondents have even filed an application in the court questioning the jurisdiction of the Arbitrator.
There doesn't seem to be an end in sight. What can be done? Is there nay way the Court can intervene and speed up things?

Dear Experts,
My mother has two names. One is her maiden name (eg. Cathy Smith , she is not an indian by birth) and when she moved to india with my father, his family called her by an indian name (eg. Savita Naik)
So now she has two sets of documents.
Under maiden name she has the following:
Birth Certificate
Marriage Certificate
Passport
OCI (overseas citizen of India card)
Under Indian Name :
Ration Card
Adhaar card
Pan Card
Bank Accounts
Property
My father is no more, and we dont have any legal document stating the Indian name was changed legally. I think they just started using her indian name and applying for documents.
I would like to change this and get all her documents to her maiden name.
Is that possible? How can I go about it?
I am applying for her visa abroad, and I am worried these name inconsistencies will cause her visa to be rejected.
Please advice.

Dear all,
I had applied for the survey of my land in Sarjapura, Bangalore. It's been 3 years now, but no one has come to do the survey even though it's on seniority basis. How should I proceed further without paying the bribe.

sir .i have sell one property..buyer makes a registry in which he mention 6.5 lac demand draft and 2.5 lac cash. .i was no aware of the fact that we cant take more than rs 20000 in cash..in the registry itself 2.5 lac is mentioned as cash..will it be a problem for us..
