OPEN TERRACE BELONGS TO SOCIETY ONLY

PLEASE MEMBER SUGGEST ME.

ONE OF MY CLIENT OWN A FLAT ON SEVETH FLOOR OF THE BUILDING. THE BUILDER HAS SOLD THE TERRACE OF THAT BUILDING TO THE OWNER OF THE 7TH FLOOR FLAT AND THERE IS AN AGREEMENT REGARDING THE SAME. IN THAT AGREEMENT THERE IS ONE CLAUSE THAT SAYS THAT "TERRACE ABOVE 7TH FLOOR OF THE BUILDING FOR THE EXCLUSIVE USE OF THE PURCHASER OF FLAT ON THE 7TH FLOOR OF THE BUILDING. NOW THE SECRETARY SEND A NOTICE TO MY CLIENT STATING THAT AS PER MCA ACT, THE OPEN TERRACES ON THE BUILDING OF ANY HOUSING SOCIETY IS PART OF THE COMMON AREAS OF THE SOCIETY AND THE SOCIETY HAS THE ABSOLUTE RIGHT OVER IT AND IS ABSOLUTE OWNER AND BENEFICIARY. NO OTHER PARTY HAS CLAIM OR RIGHT OVER IT.
MEMBER PLEASE SUGGEST ME AND WHAT I HAVE TO REPLY THE SAME. ANY CASE LAWS SUPPORTING THE CASE PLEASE PROVIDE.

Robbery of insured vehicle

Respected experts,
a vehicle has robbery by accused,when vehicle was on the way.
vehicle was driving by owner's servent(driver) who has no driving licence.
however owner has velid driving licence.
the accused arresed,went to jail.
vehicle was not recover due to sold to unknown person by the accused.
owner file claim of the vehicle.
insurence company refuse the claim due to no driving licence from the driver.


It is not a case of accident , it is a case of robbery can owner get claim?


Any case law?

Public Religious Trust

Dear Sirs,

Could you please advise as to which law would regulate a public religious trust. From my understanding, the Charitable and Religious Acts, 1920 would be the relevant one. However, this Act appears to be be very limited in scope. Can a petition be filed under section 34 of the Indian Trusts Act, for advise relating to a public religious trust. The trust deed is registered in West Bengal and the trust property is also in West Bengal. Your valuable insights would be greatly appreciated. Thank You

which are the medical practioners authroised to issue medical certificate under Motor Vehicles Act

I have searched for the list/type of medical practitioners who are authorised to issue medical certificate under a notification issued under section 8(3) of the Motor Vehicles Act for getting driving license. But I could not succeed. Will you please inform whether an ordinary regd.medical practitioner registered with Karnataka Medical Council is eligible to issue the medical certificate? Where can I find the relevant notification. None of the search engines is able to locate and help me.

what is the eligible age of senior citizen to get priority hearing in civil suits in India.Please let me know the specific notification/circular/legislation. Also please confirm whether the required age is 60 or 65 ? Thanks

Am from Pune, Maharashtra. Recently came across a very interesting unit of measurement of land area called ARE (or R as pronounced].

Could you please explain me how to convert Are to sq.ft & sq.meters.

Or how many R = sq.ft.

Alternatively 1 guntha = ? sq.ft.

Leave & license agreement

Sir, I intent to give my residential flat on leave & license basis to a family. Agreement would be executed with husband. In my town in Gujarat registration on duty on leave and license agreement is very high as authority charges duty on license fees plus deposit equivalent to that charged on actual sale. Generally people donot get their L & L agreements registered for this reason. My feeling is that there are judgements that since in leave & license no rights are transferred because it only allows licensee to make use of the premises registration is not mendatory. In my case if i get agreement notorised and if in future any litigation happens with licensee in case he does not vacate premises etc. would court reject or consider my agreement not as bonafide because it is not registered? Will this notorised agreement not stand in court of law? In case registration is legally mendatory can i have opinion about non charging of stamp duty because unlike sale or lease no rights are transferred to licensee
