Adoption

If a child is adopted 34 years back and on most of the identification documents of the child name of the adopting parents appear. The adoption deed is not registered. Now adoption deed is missing. What is the status of the child

arbitration

During the arbitration if one party is not ready to make fees to the arbitrators and either party is ready to bear other party's fees to the arbitrators U/s 38 but still arbitrators demands fees from the other party and not allowed us to raise our side and our claims also.PLS advice it is very very urgent.

Arbitration award

An Arbitration Award dated 16 Dec 2014 received in company's favor reads at the very end as follows:

"The Claimant shall make good the deficiency in the stamp paper within three weeks".

Please throw some light on the exact provision of Arbitration & Conciliation Act 1996 that needs to be complied with.

Arbitration award

A Non Banking Finance Company (NBFC) has forcibly and illegally towed away a car without prior intimation to the borrower or the local police station just with the help of an arbitration award passed unilaterally against the borrower in his absence.The NBFC did not get any permission from any court to execute this arbitration award . The NBFC did not inform the borrower about this arbitration award either. Can this arbitration award be challenged?I have heard that NBFC has to approach the court to execute this arbitration award Where the court calls the borrower to put his say.What are the legal remedies available with the borrower to challenge this arbitration award and fight the matter? what is the time limit available to challenge this arbitration award?

Name change of child from previous marriage

Hi ,

I'm a Catholic man recently married to a Sikh divorcee with a 8 year daughter. My wife was married under the Hindu Marriage act. As per her divorce agreement , she has custody of the child.
My wife has uses my name . I would like advise on how we can change the surname of the child .

Arbitration under arbitration act 1940

A recent contract, by oversight states that dispute under the contract will be resolved under old Act of 1940 , though it should have referred to 1996 Act . I hope that 1996 Act should apply in this contract automatically . Will there be any problem? I am a novice and therefore seek guidance . pl help.Regards.

such a plea merely because that he has appointed, or participated in the appointment of, an

Benefits regarding conversion of patnership firm

What are the benefits of converting the partnership firm into private company and then to public company instead of directly converting patnership firm to public company?

P.S - our partnership firm is converted to private company first and then after 5 days it is converted into public company .
we ask this to many experts but no satisfactory answer came. Please elaborate your explaination and the benefits especially in terms of taxation and registration fees.

Date of contract expiry

In contracts, generally a LOA ( letter of award) of the contract is issued to the successful bidder prior to the formal signing of contract which takes place about 1-2 months after the LOA is issued.

Based on the LOA the contractor mobilizes his resources however the final contract is signed between the parties after the contractor submits the PBG ( performance bank guarantee) which usually takes 1-2 months as stated above.

The question are:

1. If the validity of the contract is (say) six months, should we count the contract expiry date from the date of issue of LOA or the from the date of formal signing of the contract?

2. What is the legal implication of the LOA date?

my cleints ,a bank had hired a custodian to property after 13(4) possession. can dispute to any clause of agreement open doors of civil litigation completely or shadow of section 17 sarfaesi will be applicable. cant i use assistance offered under section 14 to get these people out forcibly?......cant a custodian be treated at par with a tenant on a secured property after breach of agreement. is there a way out?
