Retrenchment & non payment of salary, gratuity etc

This is the case of a public limited company, where payment towards salary to employees is irregular during last 3 years and as of now 6 months salary is pending. EPF contributions not remitted for past 8 months. Full & final settlement of employees left/terminated earlier are still outstanding.

Now the company voluntarily terminates some employees (forced resignation) and offering some of them an employment on contract basis for 2 days duty per week at 40% of current CTC as professional fees.

But they do not commit any date for payment of salary dues, gratuity, EPF & full & final settlement.

Kindly suggest what are the options available for such employees who have served for the Company for last 20 -30 years. Also please mention relevant sections/clauses of applicable laws.

Bond period

I am working in NIMHANS hospital Bangalore as a staff nurse. Here i am having 5 year bond period, if it break 3 lakhs rupees to be paid as fine in any stage of this bond period. This bond period only for nurses and no other employees having it. They said bond period is to avoid staff shortage and for smooth patient care. But none of other central govt autonomous hospitals have this rule. So i would like to know is it legally permitted to take bond period for long 5 years from employee and preventing them for their career development. Can I challenge the bond period at court, because NIMHANS is autonomous body. Please guide me with your expert idea

Duty on rest day

I am a railway employee. Staff position in our wing with respect to the BOS is poor. Besides Admn not paying overtime since long. Sunday was my rest day. My immediate incharge serve me a memo to perform duty on my rest day. But keeping in view the above scenario i refused to work on that day. Now admn has served me with SF 11. I belongs to COMMERCIAL wing sub part of Traffic department. Its other part is Operating wing. In that wing also staff doing duties without availing rest for months. Please suggest me the best option.

Departmental enquiry

Hon'ble Experts,

I am a central Government Servant. I had faced departmental enquiry wherein the Inquiry Officer has submitted his report as charges proved. The Disciplinary Authority has served me a copy of the IO report to file my comments/objection on the same. The IO report is perverse and biased and not arrived based on the witness deposition. He himself has presumed the events and reported that "might" have committed the offence and concluded the report as charges proved. Whether the IO final report can be challenged before CAT bench at this stage or else I have to wait till the orders of the Disciplinary Authority? Please clarify. Advance Thanks for your reply.

Provident fund

P.F. Dept. as per EPF and MP Act, 1952 is levying the Interest U/s 7Q and penlty(Damages) u/s 14B on the belated payments and issuing the notices from the financial year 1992-1993 onwards where as now we in 2016-2017. Is it valid?. is there a time limit for levying such interest and damages, if so, what is the time limit. But, demanding the interest and pently(Damages) beyond 5 years is not justifiable. kindly advice in this regard.

Request for transfer from current place due to medical reasons

Dear Sir,
I had been working in govt. of india for 1 year and i had been posted at Visakhapatnam.
My wife is suffering with cancer and she is undergoing treatment in Tata memorial centre, Mumbai.
So can i approach my department for my transfer to Mumbai, so that i can provide her better treatment.

*Is it possible to get transfer for medical need of family.
My department headquarters is at Mumbai only.

Undertaking

Respected Experts
I appeared for the post of Junior Hindi Translator through SSC and i was selected in the final result.At the time of interview I had to given an undertaking to SSC that I will get in written by Delhi University that subsidiary courses are equivalent to concurrent courses or else they will not allow me to appear in the interview. Actually some years ago, Delhi university has changed the names of Subsidiary courses to Concurrent courses and it is already mentioned in the prospectus of that year. I tried my level best to get it written by Delhi University but no one was ready to do it.Now the department for which I am selected is demanding that I should get
get in written from Delhi University due to the undertaking that I have give at the time of interview. But after the interview SSC never asked me about the undertaking. If any document is left, SSC gives 7 days notice and if document is not submitted, cancels the candidature of the candidate but no notice was given to me by SSC. Please advice what to do.

Promotion reversion


I need your valuable suggestion on the following matter :-



1. When the highest authority of my Corporation (CMD) had approved my promotion based on passing the prescribed examination, then is it open to the authority to revert me after a lapse of 5 years. (My promotion was not based on any misrepresentation or fraud.)


2. Whether the department can recover the amount paid to me despite the fact that I had shouldered higher responsibility and paid according to the post I was holding from the year 2011.
