Sirs.. A terminated employee has submitted form N before Controlling Authority after 27 years that he has not received Gratuity from the company...citing no reasons of delay and also not submitted any documents such as termination order, payslip, id card & no valid documents to ascertain whether he was employee of this organization...The Controlling Authority has issued FORM "O" Notice for appearing before the authority. What will be reply against such notice..can management engage Advocate? .

A Workman has complained before Asst. Labour Commissioner stating his transfer to other is illegal.
Sirs..Can a Workman a raised this individual complaint before the Labour Court without espousal of his Trade Union. even though he is member of a Trade union. Is it admissible u/s 2k of Industrial Disputes Act.
Pl advise...how to reply from management side to the Labour Court.

My application for summoning the respondent as witness on my behalf has been dismissed by Labour court. Now I want to make revision/appeal before High Court and what is the time period.

I am gopal singh.Recently I have join as a Pharmacist in IIT college.I am B.Pharma graduate.They have notice for this job is 20000 per month only.But i read somewhere supreme court order for contract base job salary will same as permanent.Please suggest me.

I had given resignation due to continuous mental stress that made me severely ill.Company asked me to serve notice period .I told I am unfit as soon as I will recover will serve notice period,but they send a notice for payment of 2 month salary. But working conditions were very bad I am a women and we're asked to work till 10 pm , due to more work load and insufficient staff.can I go to labor court and file a case against them ,one more thing they are not giving increment they says that u left the company so you are not eligible for that.

Company paid productivity and loyalty bonus thru salary and IT has also been deducted and paid to IT.
On resignation, they want to deduct the amount paid under this Head with retrospective effect.
I hv requested them not to deduct. There is no agreement between the Co and me to this effect. Their 2nd circular does not state that money would be recovered.The period of the first circular has expired.
Even if a circular is issued today , it would not be retrospective. If it is then, my letter is before and has to be given weightage.
If the Co deducts then, can I go to Labour Court and or fight in Civil Court.Parallely or after LC.

Hi,
I have a query on gratuity . I have worked 4 yesrs 9 months in a company of 6 working days per week . The duration was 17th Sepetember 2008 to 25th june 2013( total 4years 9months 8 days). Company was limited organization.
Could you please tell me wheather i am eligible or not ?
I approached my Previous company HR person ,What they are saying that they are linked to LIC related to Gratuity Payment. So as per their policies you are not eligible. Please clarify I am eligible or Not.

Sir,
I worked in central government from 1996 to 2011. Thereafter, in January 2011, I got selected in state government in a gazetted post which is equivalent to Rs.15100-39000 (Grade Pay Rs. 6600) scale when compared to central government 6th pay commission scales. I have availed pensionary benefits on pro rata basis for the service rendered in central government. I joined state government on the very next day I got relieved from central government, without any break in service, and since then i.e., January 2011, I am rendering service in state government and now covered under New Pension Scheme.
Now, a post in the Information Technology cadre in Pay Band-3 with Grade pay of Rs.7600/- is notified in central government which prescribes the following requirements.
(i) 7 years of IT experience.
(ii) 5 years service in Pay Band-3 with Grade Pay Rs.6600/- or equivalent grade in parent department.
My doubt is since I have taken retirement benefits till January, 2011, will the first requirement of 7 years experience will be satisfied. I have no Break In Service and I availed pensionary benefits as I had the option to avail that.
My new department in the State Government has Service Book from 2011 onwards, and the earlier Service Book till 2011 is closed by the central government as I availed pensionary benefits.
In the Application Form while applying for the IT cadre post in central government, I had filled all the service particulars starting from 1996 to till date, and my present state government department has put stamp certifying that all the details are correct. However, state government department has no service book of earlier service.
I could not think much while applying and applied in a bona fide manner. Please guide me will it create a problem once I am selected and joined in central government.

In advertisement:
Qualification was bachelor in veterinary
*phd & master degree holders were in prefential criteria
Now the commission has called students for direct interview in which:
General - 75% above ( either in bachelor or master degree)
Sc//st/bc- All eligible for interview
PhD- all eligible for interview
My query is:( I am not having more then 75% in bachelor & master degree )
Where is the preference to master degree holders
whether it is not mandatory to call three times the posts in advertisement
whether the preference is to be given to PhD students only (as the same is to be given to masters also as given in the advertisement itself )
whether the% criteria is only for general category students only
