Production Incentive Scheme

Dear Sir,
Please advice, can a customised production incentive scheme be formed under which all the workers are paid a uniform rate of production incentive say 30% of basic wages. Under the scheme all the workers will be paid Production Incentive if month's actual production exceeds target production. What are the records to be maintained for this and what are the other legal formalities regarding this.

1.WHT IS THE LIMIT OF EPF DEDUCTION BY NUMBER OF EMPLOYEE AND BY AMOUNT.

2. WHT WE Should be deducted amount paid to a contractor (sweeper , labour or any other labour which was working in a contractor)

While fixing the Salary, what should we compare with Min wages, is it basic or gross?

Is it necessary to include DA?

Is it necessary to include HRA?If yes, at what rate?

Holiday on Election

Dear Sirs,

Is it necessary to declare a paid holiday on the day of Election (16.04.2009) to the parliament of any private industrial undertaking

Whether the holiday declared under the provisions of negotiable instrument act is applicable to private Industrial undertaking.

If the Labour commissioner issued any orders for grant of holiday for the day of Election under the Representation of the People Act,1951 , whether it is binding on private industrial establishment.

Earlier we are providing necessary time to the employees for exercising their votes not as a full day holiday. Is it necessary to declare election day as holiday based on the orders of Labour Commissioner.

Seniors please advise.

disclosure not to defame but to disclose the facts

if a criminal discloses certain facts not with the intension to defame other but to share his experience and some channel make a serial on it with his consent (that of criminal)

1 wt the person so defamed can do?

2 wt compensation/ damages he can ask for?

3 wt sec will be his support?

4 can he will take the action agaist both - criminal and tv channel ?

Employees Payment

Dear Member,
In a case the employee work on a payment of Rs. 5000/-(TA & DA paid seperately) from last 2 years. but he did not get the Salaray and TA DA from last 10 months. Now he leave the company and write the letter to the company but co. did not reply.

The co. is not registered and haviong no registered office but my client provide me the Banglore Address but whereas my client receive the appointment letter from NASHIK (Maharashtra) and he submiited all his reports at NASHIK.

1) Whether I can file suit in Labour Court for recovery of his payment. Pls provide provision.

2) Whether I have to serve notice to both the Offices, provide Limitation.

femaly member of insurer

my cleint is the son of insurer.after accident he was not able to work so i have fild case under workman compentation act but labour judge said my client is not entitle to get compantation because he is the family member of the insurer i want any case law about it

The above rules have been recently adopted by the State Govt. of Orissa. Under the rules what are the statotory complainces of a Principal employer, engaging contractors.

Which part of the cost of the project shall attract the cess of 1% and payable and by whom, whether the Principal Employer or the contractor?
