I married on 30th April, 2012 and have one 5+ year old daughter. Our married life has got into lot of downs and finally I am made mind to end relation due to following reasons :
---- Gradually, wife has taken all jewellery items and other her belongings , and put all in her parents house.
----- Have got to know about Extra marital affair ( having recordings/messages ) but not having any proofs of meetings/photograph/video.
----- Few times physically torurered me ( but having no proofs )
She and daughter currently staying with her parents home since 1 month and there is no conversation as I am not willing to bring her back. Can you please help how strong my case could be for divorce and how to deal if she files false cases against me like Dowry / Domestive violence. Also, any chances if I could get custody of child ?

One of my friend used to talk to a married woman.she used to call him..but one day the husband of that lady heard the call recordings and conversations..Now the issue was the husband of that lady calling my friend and beating him and torturing him..he promised he never had physical relationship with her except phone calls.but he is not believing him..what can we do solve this issue and save the marriage and family..is there any legal ways as amicable settlement he is not accepting by husband. The Matter exposed in my friend family also..now his wife also showing cruelity..he was going in depression..how can I help him..

My brother's wife has filed case of Domestic Violence against all of us. We are fighting it in person. The (Respondents') evidence stage is about to finish. Before closing the evidence, we want to submit some documents like NC's and a FIR she filed against us. She has already produced the same documents before the court while filing her application. But they are all xerox copies. Even we wanted to submit certified copies of the same documents.
Now, will the documents she submitted with the application be exhibited and read as evidence if we admit them? Or the documents must be in certified form to be exhibited and read as evidence?

I got the passport with step-mother name unknowingly (I had confusion on mother name which was to give between step-mother & mother name during passport application). I have biological mother name in all other documents / certificates. Which causes an issue having different mother names.
Please suggest me to replace step-mother with biological mother name (She was died) in passport.

Hi my wife get maintenance 18000pm in dv act along with residence cost. Now she file divorce under HMP 13 1(1a). I also want divorce.she wants one time maintenance abt.50 lacks and shreedhan cost abt.10 lacs.My question is 1) maintenance in dv act will be closed after divorce or continue.? 2) I have no money any 50 lacs or more to give her then how court will decide maintenance after divorce? 3)I have right to say one time maintenance in divorce case? Plz kindly give my questions answer and not suggest to mutual divorce.i already says that I had no such huge money I.e. 50 to 60 lacs to give my wife.My wife always run behind money.she think that if demand 60 lacs in contested divorce then court will be give her at least 30 to 40 lacs.so she demand like such way.is that true?

God blessed us two sweet kids in 2010 and in 2012.
Since my wife having habit to talk lie incl every small matter. This was gifted to her by her mother.
Every time few dispute came between us due to this.
But her mother ignored her crystal clear lie.
2 months ago, from small dispute (came from her lie), she called her mother by telling her half truth.
Without hearing my statement her mother take her from my house without asking me. Every time found her mother doing like this.
My kids called her after 15 days, and she told me to come and take her from her parental house. Accordingly, I gone and ask her to come with me, but her mother asked her to say no by looking in her eyes.
They both also taken my cousin in their side as they have some secret of my cousin which disturb her married life.
Please guide me. I want to her back with me. May I File RCR?

Kindly let me know on how to proceed with the succession of the will. What all steps are needed to be taken in order to transfer the property (as mentioned in the will) to my parents and my uncles?

Ms. Revathy also joined the First year of 5 yrs. LL.B. in the same institute and she hails from a traditional Hindu family, well versed in oratory and debating skills,.
2. Faizal displayed his glorious academic achievements throughout his five years of legal academics, bagged much coveted prizes in various national and international competitions organized by various law universities.
Ms. Revathy brought laurels to her institute as social activist attending to the problems of women, children, specially-abled and hapless destitute and aged people.
3. Faizal Hasan and Revathy got infatuated by each other and decided to work together both in legal profession and life. Parents on both sides refused the proposal of Faizal Hasan and Revathy to get married on the grounds of religion and faith. However, Faizal Hasan and Revathy got married before the District Registrar of Marriages, Nyayapura on 20th. September 2007, with the cooperation and support of their friends and colleagues.
4. Faizal commands Corporate and Company law matters and Revathy in matters of Family Law, law relating to women and children.
5. As things stood thus, parents of Mr. Faizal invited Faizal and Revathy to join their family and stay with them, and accordingly they moved to the house of Mrs. & Mr. Mustafa Hasan during September 2009, and have been living happily.
6. Revathy, being enthralled by the love and affection of her in-laws, voluntarily embraced Islam on 15-10-2012, got her name changed to Mumtaz Hasan. Thereafter, Faizal and Mumtaz are blessed with a son on 6-9-2013.
7. Both Faizal and Revathy@ Mumtaz Hasan have been busy with their roaring practice in their respective fields of law, and Mumtaz became more and more popular and busy with the cases of divorced women, and the children of broken marriages, matters of succession, maintenance rights etc. She became active member in many Women organizations like Saheli, Suraksha, and Swasakti. In view of the nature of work, she became more popular among women of minority communities and backward classes but eventually submitted to the displeasure of male persons of the said communities.
8. Some sections of minority community brought pressure on Mr. Mustafa Hasan to desist Mumtaz from taking cases involving fundamental principles of Islam i.e. divorce, maintenance and property rights etc. Mumtaz was subjected to heavy pressure by her in-laws to abide by the sentiments of minority community. Despite good intentions and kind hearts, the love and affection of Mr. and Mrs. Mustafa Hasan, and Faizal towards Mumtaz had a severe dent on account of severe criticism of prominent minority leaders.
9. Even Faizal also supported his parents, started dictating terms and pressured Mumtaz to withdraw herself from all Women organizations. When Mumtaz clearly explained her intention to continue, Mr. Faizal Hasan uttered Single Talaq on February 12, 2016, and left her to undergo Iddat. He further deposited Iddat maintenance Rs.1,50,000/- in the account of Mumtaz. Mumtaz return back the amount to Faizal and left her matrimonial home along with her son.
10. Subsequently, Faizal�s parents have been persuading him to go for second marriage since he has divorced his wife. Faizal consented to oblige his parents wish to get married and the second marriage is fixed and proposed to be held on 25-03-2016.
11. Having come to know of the trials of Second marriage of Faizal Hasan, Mumtaz aggrieved by the injustice meted out to her, challenged the validity of Talaq pronounced by her husband and also sought for injunction to restrain him from contracting second marriage before the Family Court of Nyayapura. The Family Court of Nyayapura initially granted ad-interim order restraining the proposed marriage of respondent-Faizal. The Family Court finally dismissed the petition filed by Mumtaz after trial.
12. Aggrieved by the order of the Family Court, Mumtaz filed an appeal before the High Court of Nyayapura challenging the validity of talaq pronounced by her husband, and also sought for the legality on the conflict of laws involved in this case.
