Whether the cheque depositing for security will attract 138 N.I. ACT ? Please give me some rulings.

Respected sir/madam,

I have filed a criminalcase against my wife in Crpc 200 u/s 192,195,197,199,200 & 209 IPC which is punishable under IPC 193.in Apr 09 and tyhe Hon'ble court has tamen into the cognizance and issued the summoning order to my wife under sec 193 IPC. As she committed these act of offences made by her in her petition u/s 24 along with her petition u/s 13 HMA.
Now as the date of hearing has coming near , so she has withdrwan her divorce petition.

As she has withdrwan her divorce peitition as sec 24 petition was clubed .
so, some told me now no action will be taken against her in said ipc 193.kindly let me now that is it fact that she has withdrawn divorce because of that to get rid of punishment under 193.Please advice me for further action.

Taken Loan from Bank on my name by promising to repay

Dear Sir,
This is regarding the NMy one close relative has taken Bank loans fro 4 Bnaks on my loans . and assured me that he will pay all EMIs and dues in timely maner . But after few YEARS i came to know that he is not paid anything . and Banks recoved all loan ammount from me.
What shall I do to recover from My relative. He is working with RBI and know all fundas to cheat the novice persons.
Please advise.

PSS Act 2007

Dear All

I would like to know abt the PSS Act, 2007 & Negotiable Instruments Act 1881. My colleague has received a summon from Metropolitan court under PSS Act due to ecs failure. Please advice on the proceedings on the above act and how can it affect him.

1. Is it similar to each other?
2. How is it related to each other?
3. What are the consequence of the PSS act?
4. What would be the pointers of discussion on the above acts.

Negotiable Instrument Act - Section 138 - Blank Cheque

If the cheque has been duly signed by the drawer. Amount also has been filled by the drawer. Only date has been filled by the drawee, still can it be said blank cheque.

food adulteration

hello everyone,
Ineed to know authority on following facts....
That two accussed has been prosecuted for selling adulterated article of food.Is is alleged by the prosecution that notice u/s 13(2) was received by both accussed.As per record the notice was received by acc no. 1 on behalf of acc. no. 2 also.Whether it can be presumed that acc. no.2 has also received the notice?

Please let me know any judgement in this regard

False 498a allegations

My ex put false allegations in chargesheet that her father gave bungalow worth 50 lacs to me and I sold it purposely. Furthermore, her father published the same false report in newspaper.

Can I challenge this false allegations made against me in judicial custody or HC. Please advice.

Can I knock the doors of the Income Tax department to check her father's income, how he got this much money to give her in dowry? Giving dowry is also punishable as per 498a. Please advice.

regarding threaten to committe suside by fellow employee.

I have suspended one postman before 10 days. Today I have received one phone call from the office from which I have suspended the employee.

The Incharge of office tells me that the suspended employee informs me that I will committe suside.

Being an incharge of office I am informing you and passing his message to you.

Sir,

As I have not talked with suspended employee directly. I should take following action,

I should write to that employee that your office incharge told me over phone that you are going to committe suside.

Kindly confirm whether it is true ? If yes tell me the time and place so I can made complaint to the police.

Moreover It is for your kind information that before committing suside you have to take permission of president of India. Without permission to committe a suside is illegal.

Whether my action is in order or not ?

Ingredients of 304-B of IPC

Hi,
one more thing that i would like to know that what if the prosecution has this hand written letter, which treated as "DD", but has no initials of the deseased as well as not adressed to anybody, without any date on it, and to compliment that the FSL for the same is also positive? Can this be prooved as planted as it is in this case?

interim custody of article

accused was arrested and gold ingot taken into custody. subequently the higher authority of police ordered to re investigate the same and new charge filed by the investigating officer in wich the the above said accused deleted from the case.and the ingot seized from him is not the part of the case.how can i file a petition to get the ingot?.it is kept in the court. the accused is a jewellery owner
