Bifr registered companies

Sir, We are SSI registered Corrugated cartons manufacturing unit.one of my customer is BIFR registered since 2010. His DRS is still not accepted by BIFR. I have started supplying him corrugated cartons from 2008 & he has not disclosed that they are BIFR registered.He was giving us payment so we have filed case with MSME Facilitation council.During Discussions, he was trying to convince that he is protected due to BIFR registered unit.Now, As SICA Act has been repealed & BIFR has been dissolved by Government, what will happen to BIFR registered unit ? Pls. guide.

Fema

Can an Indian Private Company provide software services to a foreign unrelated start up company without having equity stake in such entity?? Due to financial constraint, if a debit note is issued & later such debit note is converted into preference shares in the first round of payment, whether it is possible??

Does having an overseas jv/wos in such cases is mandate?

Pls guide. What fema compliances needs to be fulfilled?

m in receipt of demand notice under S.13(2) demanding the loan amount as I defaulted successive 3-4 installment now i am willing to pay regular installment with defaulted installment but notice say that I have to arrange entire amount in next 60 days. Kindly advice me.

Revoke Bank Guarantee

My sister is doing a job against 2 years bond. She has submitted bank guarantee against fd of 1 lakh. But now she wants to leave the job because they are changing her post to client care eng from block development eng. She also has some harassment reasons.
Is there any way to get the fd amount by revoking bank guarantee?
Please help!

Full n final settlement

Hi,
I started working with a real estate firm (Bullmen Realty) Mumbai branch in November 2016, as a Sr.Manager in accounts, they use to give me no work, so i used to help them in making presentations and admin duties as well, slowly steadily they asked me to go on thier construction site which was again not as per my designation, They just gave the offer letter and we use to keep them asking for the appointment letter they never gave an appointment letter.
Suddenly one day the HR from the head office branch in (Noida) calls me and says that we will be now handling all the accounts work from our head office so we do not require your employment so kindly put down the resignation.
I requested them how they can do so, atleast give me notice period so i can find some other job for myself, so they called me next day to see what they can do, but again when i went to office next day, they said put the resignation , then i told them if u can't give me notice, then why do i put resignation, u release me from my work and give a letter.
So they tried to push me for the resignation otherwise we will give u a termination letter stating ur behaviour issue. So this will effect ur career so i said fine I'll put down the papers but what about my Full and final settlement, they said it would be done in 45days.
Since that day now it's more than 60,70 days & I'm continuously following up with them they are not reverting properly.
Plz tell me what am I suppose to do?

Father died without will

1. My father died without writing a WILL. He had some physical shares and a mutual fund in his name. How can the shares be transferred in my name or my mothers name ? I hv four elder sisters and none of them r interested in the shares as they r NRI. My mother stays with me.
The value of share certificate is less than 1 lakh and so going through succession certificate and all tht is not possible.

Termination from job

Iam working in ICICI Bank from 2 years. In JAN'17 i resigned to my job. Again in MAR'17 i revoked my resignation & continuing as a normal employee.

And I was almost top in ratings, but my managers gave me last rating showing reason as i resigned. And i never think of it.

Now, rumors were, company going to terminate all the least ratings.

Generally least rating given to worst performers. In HR policy it was not mentioned that resigned employees will get least rating.

Now due to resignation, i fell down from top to bottom of rating, no issues in my performance.

Now will i get terminated because of least rating ????? if i was terminated what steps i need to take ????? Please suggest me.

Liabilities of directors

We have registered a pvt Ltd company and selected for Incubation at a IIT. We took loan of Rs 5,00,000. But we couldn't make our business a successful one. So we want to quit from business. Our paid up capital is 1, 00,000. The company is consist of five directors each of having shares of Rs 20,000. Our company is recognized as a start-up by DIPP, GOI. How much money have to be paid by each director if we close our business ? Will we get any subsidy under Startup India initiative?

During loan agreement one of my relative put signature as a guarantor. Will he face any legal compliance?

Kindly suggest.

Refund issue.

Dear Sir/madam
Am from Shimoga, Karnataka.
To setup a food business I ordered a boiler from Shanti boilers, telangana in 19 October 2016 by making advance of Rs100000/-, the cost of boiler was Rs.235000/-
Due to the changes in plan I cancelled the order on 23 November 2016.
Now they are not refunding the money.
Pls guide me what to do.
In quotation also the have not mentioned anything about returns. Nor they have any refund policy in there website.

Right to transfer of shares

Sir/Madam,

My client (woman-that time she is minor) father was died in 1970.Her father purchased primary shares in reputed company in 1960's. My client had two brothers and one elder sister. Eleder sister was died in 2015.Two brothers are not co-operate and not accept to given a share of my client.
My client asking to company (1) what is the procedure of 1/4 shares of total shares to my client account? (Family /Death /share certificates information are not given her two brothers to my client)
Sir, please give right/correct information to my client obtain for her share amount.
