Medical Devices

Dear Experts,

I represent Quadio Devices, an early stage startup in the medical devices domain. Our activities range from R&D, Product design, manufacturing (we will most likely be contracting this activity), distribution and retail of digital hearing aids in India.


I would like to potentially get your expert advice on the regulations and compliance(s) (if any) that exist for a company of our activities specifically about:


1. Manufacture of digital hearing aids

2. Retailing of digital hearing aids

shares purchased but not transfrred in name

dear sir, i purchased 200 shares of jaipraksh industries ltd(OLD) but for long due to some reason i could not get them transfereed in my name. when after revdilation of transfer deed from regitrar i send to company they told that co. has amalgamated as jp associates and new sahe certificates had been send to hongkong &shanghai banking corp. the last holder from whom i purshsed through broker in market. when contacted hsbc they asked rs. 5000/- as fee for searching and original certicicate ,proof of purchae and transfer deed in original. i send all to them after that they told us to new shre certifates no. from co. ie jp .we wrote to jp whowever they gave certificate nos. now hsbc telling they did not receive shuch shares from jp and now telling us to get the shares from jp. as they are the last why jp will intertain me.pls help me and advise what to do.

Contract

My co. placed the order for puchasing of cloth for spcified quantity,Co. made an advance. On inspection it was OK but on delivery we found that it was not as per the specifications, order cancelled at that moment we have reports of Northetn India Textile Research Association, shows that counts , Mass , Density is not same as per the specifications mentioned in the perchase order, our purchase order was changed by making forged sign and mentioning the changed specifications of quality, party is claming for balance amt. of payment. kindly send your advice at the earliest.

Non perforfance of contractual obligations

A dispute regarding non performance of a machinery arises. what is the proper forum for filing such complaint. is it consumer court or before MRTP. I understand that MRTP has been subsituted with Competition Act. What type of disputes may be referred under competition act and before which forum.

International arbitration

In an agreement with foreign company, which law will govern the performance and execution of agreement. the place of execution is a foreign country. indian company will provide consultancy services along with deputing its employees for technical working of the foreign company. further for arbitration at a neutral country by which law such proceedings will be governed.

Money Suit

My firm had taken a franchisee of a company headquartered in Bangalore. After making them the payment of full franchisee fees of Rs 5 Lacs (inclusive of 2.5 lacs as refundable business deposit) via cheque, the company didnot perform and failed to provide us with the services offered by them.

We dont even have a written agreement with them. We then left the franchisee, and asked them for the total amount back. The company said that it would refund only Rs 2.5 Lacs which was paid as business secuirty deposit. We have receipts of Rs 5 Lacs paid to them.

Can I claim full refund from the company via law ? What legal steps can I take against the company for refund of full amount ?

Please advise your charges for money suit for Rs 5 lacs inclusive of all charges.
