registration under bombay shop and establishment act

Dear expert,
I have formed a private limited company in maharashtra. The main activity of the company is to provide management and financial consultancy to clients. Kindly advise as to do I need to register my company under the bombay shop and establishment act? If yes, what are the registration requirements. Please guide

E - agreements

Hi, I am creating a website where i would have local retailers to sell their products through my website. I wanted to know about the legality of E-agreements? Also, would that be sufficient if i have the retailers accept the agreement online or do i need to have a physical agreement signed by the retailers....

Example: - EBAY does not have a physical agreement with people selling through its website. It is all an acceptance of agreement by clicking a checkbox.

Incorporation of new company

My name is Rohan Shetty .
My query may be very amateur and vague.
I am a 25 year old lad born in 1986 , Bachelors in Engineering, with experience in various mentioned industries (Man power consultant : Telecommunication sales : Sales of financial products) and my knowledge is limited only upto the operations and functioning of a particular organisation , i. e i have sparse about legal liability and obligations associated . I have lately worked with a Man power consultant and have a team size of 30 employees reporting to me .

The consultancy is shutting down and this time my entire team has decided to start individual business of their own .That means 30 individual entities and each one of them wish to take the Sales distribution of the same telecom service provider . The entire cost involved in such a project involves 75000 Inr .Each one of them expect me to invest this 75000 Inr without the involvement of another individual.
I see the proposal of every individual fruit full as every individual may be working with the same telecom partner , but each one of the have a different set of client , I have to be a sleeping partner, i have full knowledge and expertise of the industry .

I have decided to start an entity of my own as
step 1 :- nature of business - funding ideas : (Proprietor ship Firm - operation from Residence)
step 2 :- Partner with all individuals separately (Sleeping partners with clause - Financial control ... i.e mandatory signing authority)
30 partnership firms with 1st partner entity (mentioned in step 1) and 2nd partner individual

I want to understand the legal point of view and obstacles. Also need a list of necessary licences and registrations requires. I do not wish to get involved in illegal activity unknowingly!

Property purchased in surfaesi auction of the bank

Greetings!
My Client has taken a house property at Chennai through a SURFAESI Auction of a Nationalised Bank.

The original borrower has deposited in his title deeds in 2006 to this Bank.
Subsequently a entry of Rs.1 Lak mortgage was found in the EC in which the borrower has given power of Attorney to X and he has borrowed mortgaging this property.

In 2009,another entry is found in EC where the borrower (There is no entry for cancellation of the Power of Attorney executed in 2006) has sold this property to another Y.

My client has all the original deeds of the property as a suceesful bidder.
Now what is the remedy for my client to raise these entries in the EC? Which is the competent authority to file petition?

Registration under bombay shop and establishment act

Hi,

If a person is involved in making handbags and operates as an individual proprietor from his residence and sells the handbags through online portals only, then is he required to resister his business under bombay shop and establishment act? The place of business is in Mumbai

Further does he needs to obtain TIN for MVAT and CST? If so, could you please advise me as to what would be the applicable MVAT and CST rate for the handbags which are made from leather and foam and jute material?

Please advise.

Cheque bounce

Sirs,

One of our customers cheque bounced reasoning "Fund isufficient" with that effect we have wrtten a mail on same day of cheque bounce to pay the amount immediately.
But we have not given the writeen notice.
It passed 10 days of cheque bounce.

Is it necessary to give in writing or the email is considered as notice?
