Partnership company

Hello,

Currently, I'm pursuing MBA at Symbiosis. I have query, regarding the partnership policy.

Assume a partnership firm, lets assume A, B and C to be the partners of the firm.... Each of them have a wife and a kid who is minor.... Unfortunately one day, all the 3 partners and their wives expires.... what will happen to their firm ?? Will their kids be given the authority to run it? If so, when can they and what would be the clauses ?

Can someone throw some light on this ?

Sarfaresi act

would like to meaning of contructive/actual possesion notice pasted on shutter of my locked premises which are under my control but were given as security to bank for a/c which became n.p.a and further notices and other procedures were done by the bank.usually banks take symbolic possesion when premises are locked and nobody is around what is the differance as even in this case it is same but language used is contructive possesion but they not put any seal or lock but only pasted notice stating they have taken constructive possesion, please inform me differance and remedy to defend

Breakup after 30 years

Two of us, have been running a successful and profit making Pvt. Ltd company and a partnership company, established in 1980-81. One day one of the directors and partner said that he would like to split and be in the same business. The other director agreed and decided to walk out. Is he entitled to any Opportunity Loss or Goodwill or anything of this nature besides 50% share in assets and liabilities.

Vehicle damage

Sir,

I have purchased one Hyundai Getz diesel car from the original owner. The vehicle is regularly maintained at the Company's
show room only. The vehicle was to be maintained every six months or 10000 KMs whichever is earlier. The next service was due on 30-05-2012 and has run only 9000 KMs. However the engine was damaged due to mixing of oil with the coolant as the rubber inside the engine damaged which is not due to the fault driving of the owner/driver. On complaint to the show room and the Head OFfice, they replied stating that since the warranty period has expired the cost of spares and repairing has to be borne by us only.

My quiry is, since the vehicle was regularly maintained by the company only and there is no break in the service, is the company not liable for the damange for such a major damage to the engine which has run less than 40000 KMs only.

Problem in pacenet broad band connection.

Sir,I have Pacenet connection,01 year plan, since 28 June 2011.Since connection I am facing problems in net.For that I had done uncountable phone calls & mails.At last on 01 Jan 2012 I mailed Pacenet Indore to disconnect my service & refund my amount.Even after every 3-4 days I mailed for the same.Just have the look on my recent mail . Subject: No way to continue with Pacenet due to in justified behavior by Pacenet head Indore.

Attent: Shri Suresh Mittal Pacenet Indore Head. I approach Pacenet Indore office to give writing complaint on 01 MAY 2012 but Mr Mittal had not take it.He want to discuss issues.Pacenet head Mr Mittal also told that,he is unaware to my problems & issues, I faced since connection.It means that my more than 100 mails regarding complaints have not forwarded to him by Mr Manoj & Mr Pawan. On 05 May 2012 I again went to Pacenet Indore but Mr Mittal was on leave. But shocking incident I faced on 12 May 2012 in Pacenet Indore office.Madam told me that Mr Mittal is in meeting.I asked her that I am coming from 11 KM & it is 3rd time.After 15 min Mr Mittal totally deny to meet me,A PACENET CUSTOMER.I was stunned to hear his order.Although I meet MR Pawan.But Mr pawan was helpless. MY writing complaint dated 01 MAY 2012 is : I had Pacenet broad-band connection since 28 June-2011,having order form no:4920/17-06-2011 & paid Rs 3300 for that 01 year plan.Since the connection ,I am facing repeatative problem in net, such as: system hang,cable fault,power issue,fiber fault,signal drop.For that I had made more than 450 phone calls & e-mails at every net failure.I had mentioned all problems,since connections in my mails.Along this main issue for un satisfaction are: (1)Complaints forwarded only between 12:00 noon to 18:00 Hrs on week days only,when seniors available.It means that if problem occurs after 18:00 Hrs on Saturday,it will be forwarded to seniors only after 42 Hrs at 12:00 noon on Monday.If monday will holiday then it goes to next day. (2)Your junior staff have not authority to give phone no of seniors.They only take complaints & forwarded to seniors on their available time in office. (3)Since connection one of the major problem system hang occurs from NANAK NAGAR station (Virender Hardia).You had taken 09 months to change system after my more than 50 mails regarding system hang & personnel meeting with Mr PAWAN.This problem gives me lot of pain because problem was in front of my house & its rectification time was only 01 min.But I faced more than 75 times this particular problem & every time You had taken 06 hours to 42 Hrs for it.Most of time I had requested to MR Virender to restart this system. (4)I have power back up.But PACENET not having power back up in Indrapuri & Nanak Nagar station.For that since day one I have told & mailed to seniors.In Nanak Nagar area almost every day power cut problem occurs .Due to lack of service I have taken another net for my share trading work.I use PACENET only for surfingdownloading & education purpose .(5)At every net failure complaint I have to made many many calls to different no for reminders.Most of times seniors numbers 0731-4262020/24/26 not responded.Total RS 980 I had paid for phone calls only . From Jan 2012 I have arrange mail address to complaint. Due to all mentioned reasons I will not be in position to continue PACENET.I am requested you to refund my Rs 3300,as PACENET gives me lot of
mental tension.)
Pl suggest me what action can I take.

Regarding ssi/nsic service sector facilities in govt/govt. undertaking tenders

Sir,
If any Govt./Govt. Undertaking calls tender without mentioning anything about SSI/NSIC Benefit in their clauses of tender and if one of the bidder comes with demanding these facilities on tender opening what will be the legal steps to be taken out by bidder for availing the facilities like...EMD return(though he deposited), 15% rate relaxation against 1st lowest who is not SSI/NSIC accredited and exemption of SD in terms of BG/Performance Guarantee. The bidder has submitted all the related docs on SSI/NSIC during submission of Tender. If the authority do not decide the matter favouring SSI facilities what legal steps to be followed by the BIDDER.
