Sofa cheating !!

We saw the ad in olx chennai , that the seller ( devaraj ) is manufacturing and selling new sofas under the name ( thirumala furniture ) , we ordered 3 sofas of rs.42,000 worth , so in advance we gave rs.8000 in cash , but he didnt gave the bill , instead he gave a written statement... he asked one week time , so after a week, we kept on calling but he didnt pick up the phone, and atlast after 14 days he called and said sofa is ready , so we went to his factory to see it, but to our shock , he hasnt made the sofa as we said, it was fully wrong(size difference, color differenent, shape different .... ) and it was so horrible looking like a second hand... not even worth for rs.10000, so we said we dont need the sofa , and asked him to better return the amount of rs.8000, even we asked him to deduct some amount and then give the balance... but he was so stubborn and said i will alter and give u the sofa , he spoke as though we are getting a second hand sofa... we said no need and asked our amount of rs.8000 , but he rudely said to go wherever u want but i wont give ur rupees... he even said why are u calling me and troubling and asked us to call his partner and ask, we gave our amount and order to him only , but he is shouting us to call his partner, he was this irresponsible and he has cheated us, still the sofa and my amount of rs.8000 is with him..... so now i have the following evidence : 1. call record 2. written statement( no bill ) which he gave that he has recieved rs.8000 , so is this 2 evidence enough to approach consumer court ?

Why the need arose for spl. m. act in spite of h.m.act which is prevalent

Learned Experts, my marriage was solemnized in the year 2013 under Special Marriage Act, 1954. Before the marriage, the bride party had published an advertisement asking for a groom, in a leading Bengali Newspaper in West Bengal. I telephoned, talked to them and after several sittings, the marriage was materialized. After that, the relatives of the bride party engaged a Marriage Register for their choice, gave notice on 9th November, 2013 and the marriage was followed by Registration of Marriage on 13th December, 2013 under Special Marriage Act, 1954. It was their unilateral decision to engage a Marriage Registrar and get the marriage solemnized under the Special Marriage Act without any consultation with me or my family. My family consists of my ailing-aged-uneducated parents who are affected by multiple diseases i.e. COPD, Diabetes, High pressure, Angio-plasty (Heart) and Hearing problems and one sister who is under-education-aged-unmarried-unemployed as well as me. The rituals of marriage were held. My query is whether my marriage was held through Special Marriage Act or Hindu Marriage Act. Both of the family is Hindu and Bengali. So far as I know only Special Marriage Act is applicable to different religions. Is Special Marriage applicable to me? In spite of Hindu Marriage Act which is prevalent, why the need arose for Special Marriage Act? I am eager to know that. Pls. advise me.

Special marriage act 1954

Respected and learned advocates, my marriage was solemnized in the year 2013 under Special Marriage Act, 1954. After that, the relatives of the bride first gave notice on 9th November, 2013 and the marriage was followed by Registration of Marriage on 13th December, 2013 with help of a Marriage officer, under Special Marriage Act, 1954, then the rituals of marriage were held. My query is whether my marriage was justified or not under Special Marriage Act. I am Bengalee and my wife is also Bengalee. Both of us are Hindus too. So far as I know only Special Marriage Act is applicable to different religions. Special Marriage is applicable to me? Pls. advise me.

Parking issue with neighbour

HI m residing in Vadodara in a cooperative housing society where no president or any responsible person is there to look after society issues. My neighbour is creating me a problem parking his four wheelers, two wheelers in our driveway. coz of this the road towards my house remains blocked. as our opposite houses are closed, we manage to use their driveway with little space. 15 days back because of this we had a fight with him not physically. last so many months they were harrassing us by parking their vehicle in our driveway. but we never tell them thinking they are our neighbourn all. 15 days back when we were not able to park our four wheeler inside, i requested them to remove his four wheeler and park properly as half of our driveway he blocks with one four wheeler parked. then he refused to do so and were telling you keep your vehicle outside i will not move my vehicle and started abusing us.finally we managed and park our vehicle inside with exact space of our vehicle size. on 3 day i complained to police deptt. after 10 days police came and inquired and taken our statements and asked neighbour to report to police station on 2nd day. after that we dont know what happened.after 4 days police came to my house and informed us my neighbour has also complained for us and we have to go to police station. we went to police station, they have taken our statements and completed all formalities i.e. bail and all and closed this case. i asked police what is the meaning of my complaint. as still today only my neighbour has parked their vehicles in our driveways that also you can say permanently as they hardly take out these vehicles. two wheeler they parked horizontally so road towards my house remain blocked.my question is now whom should i contact who can resolve this issue. in my opinion this is society internal road. he should keep open the road for our driveway as he has parking space aside his house but still just to trouble us he park inside the house. as per new rule in gujarat, society president has to resolve these type of issues but as i mentioned we dont have any president or caretaker.in this case who should i contact.pl help me to sort out this matter as i want to live peacefully, i will be grateful to you. Thanx.. secondly which driveway we are using currently adjacent to one house is closed. its condition is not good. 20 days back only one window ceiling has broken. anytime any part of the house breaks. so it is very risky still we pass from this house only as opposite house ie. neighbour house has blocked our driveway towards my house with his four and two wheeler parking. now pl advise what should i do? Thank you in advance......
