whether deposit kept by tenent for the rented house can recovered by the tax recovery officer for income dues of tenent u/s 226 (3) of the IT act. But the deposit is conditional deposit, in the sense that if the tenent fails to pay rent it is adjusted against rent, and if there are any damages it is adjusted,

Which ITR to fill?

I am a teacher in a college. I have income in the following Heads.
1. Income from salary (As per Form 16)
2. Income from articles published in newspaper
3. Income from invigilation duties, guest lectures and examination work (besides salary as mentioned in point 1 above)
4. Interest Income from NSC, Fixed deposit and savings bank a/c
5. Loss from MCX (Commodity trading) and share trading (interday and intraday)

Kindly let me know of the ITR Form to be filled by me. Also the column of the suggested ITR in which the above mentioned incomes and losses are to be shown.

civil contractor under compostion scheme

Respected experts,

one of my client is a civil contractor under compostion scheme in haryana he charging vat @4% on receipts/workdone.

My query is that if above contractor done the work for forest clearing for starting a site.You know that for forest clearing no material involve only labour involve. Is VAT is applicable for that work done.

TDS CERTIFICATE-PAN NUMBER NOT MENTIONED

Dear Sir,
My daughter is a NRI.She has fixed deposit in a bank, the PAN number was not advised to the bank.The Bank has deducted TDS and has given form 16a,without mentioning PAN number.My daughter wants to file ITR to claim refund of Rs 2439/,26AS does not show TDS deducted.How the tax deducted can be claimed.

false case of cheque bounce

I have been framed in a case of 138NI(cheque boucing).
The complainant claims to have given me a loan of Rs 28 Lakhs in cash(14 in one year and 14 in next yr) against which they say I paid them an interest of 3% per month for one year. They have shown in complaint that the money given was for earning income. In first time they are not showing the source of Rs 14 Lakhs in cash. In second time they claimed to have sold off her jewellery and procure Rs 14 Lakhs and given me.
The period they are talking ins 2006-07

Fact: No transaction of that sort happened. They are not of that level to possess even Rs 2800/- leave aside Rs 28Lakhs in cash. they have not filed any income tax return for last several years.

My Question: How can I use their statement against them. How can I take help from IT dept. What would be penalty/consequences of evading tax on Rs 28 Lakhs for 6 years?
What would be the amount of penalty be?

Excess TDS

(A factual example)

For the Qtr 1 F.Y 10-11 , a provision was created on which 10% TDS deducted .For e.g On Rs. 100 provision 10% TDS is deducted ie Rs. 10.The client got Rs. 10 Credit.But the actual payment turn out to be Rs. 80 for which actual tds Turns out to be Rs. 8 .Now the Rs. 100(Income) has been reflected in client's 26 AS statement along with 10Rs TDS.Client is requesting to amend the return/certificate, such that the income is reflected as Rs. 80 as if takes the whole credit of Rs. 10 he will have to show income of Rs. 100 which is not actual income.His income is Rs. 80.Now question whether return/certificate can be changed to reflect in his 26 AS statement income as Rs. 80 and TDS as Rs. 10.The extra 2 Rs. TDS for which client had taken credit will be adjusted in next payment..


The F.Y in which TDS was deducted is F.Y 10-11.Whether it is possible to adopt the above procedure?

Refund cliam against TDS deducted U/s194B

I have own a lottery against which i received the proceedings after deduction TDS u/s 194B, if agreegate income does not exceed 1.6 lac after including lottery i.e my taxable income for the year is zero.
can i refund claim for the TDS deducted from lottery prize.
