Tds deduction dates in 26as and it refund





Dear Sirs

I was working for the company in Rajkot from Jan 2006 to Jully 2011.During the first year company paid my did not deduct TDS from My Salary,but they paid it to IT dept on my name, and when my return for Assessment year 8-9(financial year 7-8) was paid to me by cheque by IT Dept,the amount was debited to my account by company.I don’t object to this.
But from financial year 8-9 i.e.assessment year 9-10,company started deducting TDS from my salary.I filed my returns from the same tax consultant of the company who was looking after the tax matters of the directors of the company as well.
For Assement year 9-10 I received my IT refund,But in the same year I received notice from IT Dept, to pay Rs.35210/ as fine, (in the attached statement they did not consider my investments Under Chapter VI-A and TDS).
I gave this notice to the same tax consultant,who filed my return.He said my TDS has gone in Wrong PAN A/c,hence I received this notice. And he will take care of it.
For the financial year 10-11,again I filed my returns with the same tax consultant, and I was expecting my I.T.refund of A.Y 9-10 & 10-11,but again I received notice from I.T.dept demanding Rs.38870/ as arreas as they didn’t consider my due investments Under Chapter VI-A and TDS.
My consultant told me there are 1000 of notices of this kind by Rajkot IT dept as they had hired Data Entry Operators who committed this mistakes.
So long I was with the company I had /n have fullfaith that every will be set right.
Now I left this company in jully 2011, and while checking my TDS Form 26AS for the above year I got following details
For Assessment year 8-9(financial year 7-8),for 26AS , in Part A- TDS Deductors is showing only for 6 months with TDS Booking column October 2007 for 3 Months and January 2008 for rest 3 months and not for full 12 months.
For Assessment year 9-10(financial year 8-9), for 26AS , in Part A- TDS Deductors- is showing only for 8 months with TDS Booking column giving date 15/06/2011 for 8 Months ,and balance paid (in Part C of 26AS) on 12/1/2012
For Assessment year 10-11 (financial year 9-10), for 26AS , in Part A- TDS Deductors- is showing for all 12 months with TDS Booking column giving date 15/06/2011 .
Aslo 26AS in its part B-details of paid refunds show A.Y 7-8 is paid by Paper on 7/7/2009 nad for A.y 2008-9 as paid by paper on 21/12/2009

My refund for the Assessment year 2009-10, for which I was served notice by IT Dept in that year , was shown as by IT dept as “Adjusted against outstanding demand. (CIN-BSR code 0004329 Challan deposit date - 12012012 Challan Sequence no - 33446) on Jan 13, 2012 by ECS.
And my refund status for 10-11,11-12, shows Your assessing officer has not sent this refund to Refund Banker.
I am trying to contact my consultant who dealt with this issue is now not responding

Pls advice me what course of action available to me, and can I claim this amount & from whome

Rate of stamp duty charge on intra-day equity trading.

KARVY STOCK BROKING Ltd. has deducted Stamp Duty charges @ 0.01% on turnover for Intra-day trading of shares, but ICICI Securities Ltd. has deducted @0.002% on same instrument. KARVY explained - it is applicable as per norms of West Bengal Stamp Duty Charges. ICICI Securities explained – rate (0.002%) is applied as per rules of SEBI/NSE. Now, my question is, who is correct and what should be the correct rate? Definitely we should not pay more (as charged by KARVY @0.01% on turn over) when there is provision for lower rate (as charged by ICICI Securities Ltd.@0.002% on turn over).
In this regard I have attached a .pdf, which has sent by KARVY to me, and referred page no 21 and 22 to justify the rate of stamp duty charge applied by them.So I would request to see kindly the said pages wethear this is applicable or not. Here, it is to be mentioned that both broker is registered under NSE/SEBI, and both are in West Bengal, then how the rate for a same instrument could differ from one to other.
May I request you to kindly help me by providing the correct information on the issue mentioned above.
MY QUERY IS RELATED WITH RATE OF STAMP DUTY CHARGE ON EQUITY INTRA-DAY , NOT FOR EQUITY DELIVERY TRADING(Charge for Delivery is @0.01%).

Fix deposit tax calcualation

i'm working in aboard and would like to FD
30 lacs in my SBI saving account. So 9.25% it will go approx 3 lacks interest per year. So, i will be eleigible for tax pay. kindly advice.

Reduction of vat credit

As per Gujarat vat notification dealer in gujarat has to reduce vat credit at 2% if he do OGS sale.

My querry is that when i calculate credit reduction by using proportionate method which one persentage i have to take form following

1) Ogs sale with c form
______________________
Total sale


2) (Ogs sale with c form )+ (ogs sale without c-form)
__________________________________________
Total sale


I think 1st one should be adopted as per gujarat govt. intention...

Transfer of proerty

Dear Sir, My son and I hold a flat jointly in our name. We want to transfer the said flat in the name of my daughter and my wife. There is no transaction or consideration. The flat is less than 3 year old. Will we have to make a sale deed? Will captial gain tax applicable and how will it be computed?

Financial assistance

Haryana Government Service Rules earlier provided for employment of next eligible in case of death of an existing employee. However the practive of providing alternate employment has been dispensed with and a monetary help in the shape of financial assistance is provided to the spouse of such deceased employee which is equal to his/her last salary drawn and it continues till such deceased employee (if alive) would have reached the age of retirement. There-after the spouse gets normal pension/family pension as the case may be.

My querry is whether such assistance is "Profit in liew of Salary" or is taxable under the head "salaries" or is taxable under the head "income from other sources"

Capital gain

ajay have purchases a plot on 25/06/2009 of rs. 1650000.00 and ajay expire in sep 2010, now his 3 son have decided to sold the plot today in rs. 2400000.00, capital gain will be charged ? the all three son income nil in f/y 2011-12 & in 2012-13 aprox. Rx. 75000/- each.
