Dear Team,
I had purchased a flat in Mumbai and the sale agreement registered is dated 10.10.2010. This was resale ie., During this time the builder was in possession of the maintenance since society was not yet formed hence Bank for granting the loan needed an NOC from builder for mortgaging the flat. For providing the NOC the builder made me to sign an undertaking which mentions that I am aware that the VAT for the said flat is not paid and that if any demand is raised, I shall pay the same. Now the builder has sent me a letter for paying the VAT. I understand that VAT is payable by the initial buyer who purchased the flat from the builder in 2008 and since my sale agreement is dated 10.10.2010 and the same being a resale and completed flat will not attract VAT. My query is whether the builder can obligate me under the pretext of the undertaking signed by me to pay the VAT as an end user. Thank you in advance and your advice /response will be very useful for me to plan my next steps with the builder / original buyer

Hi,
I Purchased an underconstruction property in july, 2007 and that time the builder has not mentioned me about VAT tax. and now he is asking me to pay the applicable tax on my house.
My Question is..
1. Is the VAT tax is applicable to builder or buyer?
2. If needs to be paid by the buyer then whether i will be getting any government receipt for this?
Urgent capital gain query
Dear Taxperts and lawyers
Suppose if there is a flat which is for more than 3 yrs in the book of accounts later it was sold
Now it falls under Long term Capital Gains Later on I buy another flat (which settles previous flats gain but it is more costly therefore it is only booked for which allotment letter is given ) within one year
the flat is there in my book for 1 yrs and that the new flat bought is mentioned in IT return filing
but after 1 yr I am unable to pay the entire proceeds required to buy the new flat builder says he will sell it to other party and that allotment letter stands cancelled
My question is
1 What will be the Tax implication in such a situation
2 Will I continue to get d time frame 3 yrs from the sale of old flat
3 If I sell the new flat or surrender the new flat builder under distress and if there is no capital gain will i still be entitled to short term capital gain
