A is a retired person, who is providing advisory services to a company with the designation "ADVISOR". The company pays him a fixed amount every month but he is not on the roll of the Company.
At the end of the year, the company issues him Form 16 under Income Tax Act. The advisor contends that Form 16 is applicable for employees and not for advisors.
Is Advisor right? If so, which form should be issued to him by the Company in place of Form 16.

I Purches one plot in 1992,that time my plot is coming under gram panchayat, I constructed house on that plot. regularly I paid tax to gram panchayat. after that in 2000 our area is came under municipal corporation. from that time till now I am
submitting my tax(Ghar Patti Pani Patti including tax)regularly to municipality. now when I asked to tallathi he his asking me land tax for the above said plot on which my house is constructed. as per rule is it true/wright to pay the tax for one plot to the difference authority like municipality and tallathi both please give me replay

Can anyone give advice regarding 54EC. If the amount recd from selling a house has not been put in the capitals gain tax savings bond within six months of selling the house, then what is the procedure to be followed for exemption from capital gain tax. Is there any way for capital gains tax exemption if the amount is put in a capitals gain tax savings bond after 9 months of selling.

Dear Sir,
We have land of 5 acre which we are planning to convert into agriculture land through Poly house & Open Cultivation under a company books of accounts. The Land is in the Individual name of Managing Director. So My query is should we show it on lease from MD Sir or Simply keep on his name. What is benefecial from Taxation point of view.
Kindly advice.

sir, i am an employ in a university and have got Rs. 99897.00 as arrear of salary from 2005-06 to2013-14. I have never filed return in income tax department . can i get relife u/s 89 of income tax act.

I am an umemployed person having not any source of income. But, I have taken cash from different people worth Rs. 12 lakh and deposited in my saving account during F.Y. 2011-12. The purpose was to apply for agecy of LPG in my area. But unfortunately, I could not get the agency and then I returned back cash to the different persons. Now I have received a notice u/s 148 from Income tax Department for a.Y. 2012-13. What should do I as I had not any income that year and also is it a case of escapement of income as required for section 148 of the I. T. Act. Please also quote case laws in this regard.

I have submitted my online audit report for A.Y. 2013-14 within the due date. But, I have not filed yet my return of income. If I found any mistake in my audit report, can it be revised by me or my CA? If yes, what will be the process?

I have purchased one under construction flat in 2010 and same was registered on 30-jun-2010 ..According to me service tax is implemented for sale of flat from 01-jul-2010 so can you advice in my case weather service tax will be applicable or no as agreement was registered one day prior of date mentioned for service tax.. however builder is demanding service tax on instalments that I have paid to him post 01-Jul-13 stating which I have denied stating sale of flat is already done before date prescribed .. am I liable for that as law doesn't say if payments are made post o1-Jul-10 I have to pay Service tax.. if I am not liable can you please help me with section and details of act as I have to produce this in court of law in two days

1. I purchased Flat No. 1 in 1998, possession of which I got on 1.1.2000.
2. I purchased Flat No. 2 in 2002 possession of which I got in March, 2003.
3. I sold Flat No. 1 in January, 2011 & had a Capital Gain of Rs. 13.5 Lakhs from the sale.
4. I invested the Capital Gain in SBI Tax-saving account.
5. In 2013 March, I purchased another Flat (Flat No. 3) for Rs. 80 Lacs and invested the entire sale proceeds (Including Capital Gain) for purchasing this flat and borrowed a sum of Rs. 65 Lakhs further.
6. The possession of Flat No. 3 is due in June, 2014.
If I sale Flat No. 2, within one year of occupying Flat No. 3 then can I off set Capital Gain from this deal also; if I apply the Capital Gain for repayment of loan, will I be eligible to claim it Tax Free?
Filing mother's income tax return as "legal heir" because of her death
Dear Sirs,
My mother expired a month ago and I have to file her Income Tax Return for FY 2013-14 (AY 2014-15). However, for filing the Return, I must be registered as a legal heir on the Income Tax Website.
To register as legal heir, the main document required is a "Legal Heir Certificate". I need a "Legal Heir Certificate" only for filing of Income Tax Return. Kindly guide me as to the easiest procedure to obtain this legal heir certificate in Mumbai.
Secondly, we are 4 children and the other 3 do not have any objection to my obtaining the said certificate.
Your guidance will be highly appreciated. Thanks.
