Sought legal help

More than 50 years commercial tenant of two rooms,last five years continuing without giving any rent but earlier paid as the owner expired and no legal heir claimed.Presently some people appeared introducing them as nephew and nice of owner going to claim property and intend to renovate the property.We never ever seen these people earlier in this property and also the point to be noted on expiry of owner none of single person came over here to do the ritual work even body get decomposed .Now as said,already they have obtained legal papers( not seen yet)and wanted to sit with us through local councilor to discuss and settle down our claim etc.,In this connection what should be our stand points,how do we know that they are the only legal claimed people no more are existing?

Transfer of property

My father has passed away in 2009 and We want to transfer property from him to my mother , me and my siblings. So will you please tell me procedure and required documents.

Transfer of property from deceased owner to legal heirs

My Father has a property in Ballabgarh, Faridabad. But property in not mutated till now. Unfortunately, my father passed away in 2009. So i need to transfer the property from my father to my mother and siblings. So in the absence of mutation of property, What should i do to transfer the property as well as i also want to mutate property now and one thing also that we all are hindus and there is no will available made by my father. What will be procedure and charges for this? Any help would be appreciated.

Eviction of family member

My mother owns a property in varanasi which was purchased in 2003.It has got 9 rooms out of which 5 has been given on rent.
My mother has given 1 room out of 5 rented one's to her younger brother who is staying in that property with his family since she purchased it.We have not been taking any rent as he not financially so sound.

Recently we thought of selling that property and now my uncle is creating nuisance as he is not willing to vaccate the room and also threatening not to sell it.
What legal action can we take in this regard.

Handwritten Will

Is handwritten will valid in India?? It has sign of two witnesses, date, sign of my father, his statement of his sound mental health. It is written in handwriting of my father. But local lawyer refusing it's not valid.

Regarding getting sales deed

I have purchased a flat in 2010 in Pune. The land on which the building is constructed is registered as an agricultural land and falls under wagholi gram panchayat . I have index 2 of the flat and i am in possession of the flat. When the builder was selling the flat people were frustrated as he was not ready to form society and get it registered. So we the owners took initiative and got the society formed and registered. Now the society is registered under Co-Op HSG Soc. After this the builder pulled his hands from day to day activity of the society and also did not take any interest in getting the sales/conveyance deed and OC done for occupant.

We are now looking for getting this sales deed done. Could any of the expert shade some light on process of getting this done on our own. What are the document required and which office to approach and what would be the fees involved.

As per my understanding we can apply for Non -Agricultural status for the plot only after we get our sales/conveyance deed shorted out. So this is very important for us.

99 years lease

Hi,
we have a plot in (malad) mumbai for 99 years lease agreement kind of ,so technically we are on lease for 99 years, it was in the name of my grandpa and after his death names on municipal tax has been changed to his wife only and other documents remained in the name of grandpa like property card and 7/12, so now last year my grandma died and she made a will in the name of us, we have completed all the pending work in native place of property and now would like to ahead with this 99years wala lease land, there have been people living at that place amounts to 18 chawls officially and 26 unofficially chawls and out of which 1 is occupied by us, these people have registered as welfare society as soon as my grandma died. now please suggest what all the things that we can do to get some monetary benefit out of this mess situation. people over there have started considering this as lawaaris type plot.

Please suggest ,need help. If any advocate reside in Mumbai can contact me.

Bought a flat but owner raised insolvency

Hi Sir / Madam
i bought a flat in Chennai in 2014 till now it has not been constructed and recently came to know that he raised insolvency..
For the last few months i am not able to pay the EMI The bank where i took loan is saying we are not responsible u need to pay for the loan opted and threatening like we will raise case against you for cheque bounce...some sections...pls advise with your contact details

Sale of property.

Respected Sir/ Madam
I had advised my brother-in-law to purchased a property measuring 30x40 adjoining my site in the year 2009 the rate was 960000/- + cost of registration. There was an agreement to pay the full amount within a stipulated time set by the seller, The initial part payment of 4.60 lacs was paid by my BIL and unfortunately due to recession he could not make the balance payment and wanted a refund, since the seller was reluctant to repay the amount paid , I picthed in to pay the balance 4.60lacs and be a 50 % owner of the property. This was very much acceptable to my BIL after which i got the property registered in my name with full consent of my BIL i paid for the registration and got it registered in my name and since then paying the property tax / katha etc. . From 2009 till date i enjoy the usage of the property as its adjoining my house and now its an extended compound.

Now my BIL has been brain washed to get the hold of the property as there is no proof that the 2nd half belongs to him. He approached me asking me to either sell the property and pay him the amount which is close of 20lacs as on date market value or to register his portion on his name. I could feel he fears I may cheat him.

My question is
1.If i have to register the site in his name would there be a cost/ commercial transaction ? how do i show the transaction
2.Can I do a gift deed in favour of him or my sister (his wife) would that attract any charges like registration or anyother .

3. Will i be liable to pay long term capital gains for the profit made out of this deal.

4. what would be the best option to dispose the property.

My intention is not to cheat him at all.
