Sale of property which has been acquired by locals.

Joint power of atorney

Dear Sir,
I have father who is a senior citizen and who has recently operated for foot finger. We have a matter that is going in lower courts. I want to take power of attorney from my father to represent on his behalf - that is myself and my wife. In case if I am not available than my wife can represent on my father behalf. What is the meaning of phrase jointly and severally in power of attorney document. Please reply.

Availing of housing loan on joint property

Dear Sir,

One of my known person own a residential plot in the name of himself and his daughter, who is 17 years old i.e. minor as on date. He has constructed the house from his own funds. Now some work is still to be done but he is not having funds. Hence wants to avail housing loan. Kindly guide, property can be mortgaged. If yes under which section/rule and competent authority if any legal permission is required for mortgaging the property.

Validity of certified copy of link sale deed

Sir I have purchased in the year 2017 a house site basing on Encumbrance Certificate and Certified copy of Title deed (since originals were lost in cyclone). Now I have applied for loan from a Nationalised Bank. The Bank Authorities are insisting for Original Sale Deed of my seller (link document). Please tell me the solution. if with any decisions

Agreements

For any agreement (NDA/CDA/MOU/MOA) is it necessary to make agreement on stamp paper only? How much should be the amount of stamp paper (Rs. 100 or Rs. 500 or any other amount)?

Is it necessary to include the witness in the agreement (NDA/CDA/MOU/MOA)? In other words is it necessary to have signature of the witness in the agreement?

If agreement is made on stamp paper is it necessary to register it? How to register it or what are the means to register?

If agreement is not made on stamp paper is it valid? is it necessary to register? How to register it or what are the means to register?

Is probate grant mandatory

Purchasing a property,
Link doc shows ( unregistered will) property is inherited to two sons from thier father. Their father is no more..
But the will is neither registered nor notarized. Infact will is written on a plane paper dated 21/06/2011.
How to proceed is probate grant required?

Affidavits notarization from another state

Hello Sir,

1. One of our relative need an affidavit regarding nominee name change in LIC in Delhi and he asked for getting the same drafted and notarized from Gurgaon. Is it permissible to notarize an affidavit from Gurgaon (i.e. different state) and submit it in Delhi.

2. Also kindly advise if it's not the case of nominee name change, and any other affidavit then is it valid to get an affidavit notarize from one state for use in another state.

E-stamp paper

We have purchase estamp paper for Deed of Hypothecation. E-stamp paper amount is 2 lakh. estamp paper purchased for executing loan documents. Total loan amount is 10 cr, however in that there is different sub category of loan. Both bank and party is same.

As advised by bank, estamp paper was supposed to purchase as per sub catgory of loan ( 1 for loan amount of 5 cr, 2 for loan amount of 2 cr, 3 for loan amount of 1.80 cr and 4 for loan amount of 20 lakh). However we have taken estamp paper for total amount of 10 cr. Bank and all these loan customer name, date and place of execution is same.

Please advise,

Is there any process at SHCIL to take breakup of estamp paper ?

if not, can we execute one e-stamp paper for the total loan amount. Since the bank and customer name is same.

Documents needed to make pan in the name of a school

How do I make a PAN in the name of a school?
The school is in existence for the last 10+ years.
There is a bank account in the name of the school from which salaries are being given.
What documents do I need to make a PAN in the name of this school?
Is it enough to provide the bank passbook as a document?
