What is the procedure to notarise a duly registered Special power of attorney?
Does the signatory to Special PoA have to be physically present before Notary?
I sold a property on the basis of Registered Power of Attorney but did not get it registered. The person who gave the power of Attorney now says that that Sale Deed is not valid as it was not registered and i failed to get the property 'registered in the name of the person to whom it was sold. The Buyer had paid 80% of the agreed sale value and on which basis possession was given o the Buyer.
The original person on whose name the property was Registered has forcibly occupied one room in this property and has filed a case of Fraud in court.Is the Sale Deed now Null and Void? Can the (new ) Buyer be evicted ?

Generally while pursuing Bank Loan to buy property, Builder/Housing Society issues an Allotment Letter to the buyer which gives details that what is the description of the subject property being sold/bought by the two parties and also it mentions the amount of money which buyer has paid to the builder/housing society, such that remaining amount can be financed by the bank.
On the basis of this Allotment Letter generally bank finances the remaining amount.
As such the Allotment Letter also gives all the pertinent details of the Property being bought/sold and also about the specifications of the Project on the whole.
What is the significance of the Allotment Letter, is it the same that of the Agreement of Sale generally documented on a Stamp Paper, whereas the Allotment Letter is on a simple piece of paper?
If on one of the pertinent aspect which is mentioned in the allotment letter, builder refuses to give adequate documentary proof subsequently, because of which buyer does not make subsequent payment and demands that unless builder satisfies him fully on that disputed aspect he shall not make subsequent payment, and finally Builder refunds the buyer all the money he has paid to him so far.
Can Buyer make out a case of Breach against the Builder as Builder has failed to furnish documentary evidence of Municipal Approval of one of the very pertinent aspect of the project, say Shopping Complex/Restaurant or a Swimming Pool?

Dear all,
The land is situated in Maharashtra. The land record shows under class 3 & devstan trust in other rights . The owner was applied in 1972 against the case against trustee towards charity commissioner for finding the fact. After verification it was unregistered trust and given award accordingly. After it was registered on ferfar document i.e. 6 A in Tahsil but remain unchanged on 7/12 EXTRACT IN 1976.Present 7/12 shows DEVSTAN & 5 owners names class III.
Now the land owner sold their land to X person & did sale deed agreement and enjoying physical possession. After registration tahsil dept. refused to record X name on 7/12 stating that land belongs to Devstan(HINDU) & comes under CLASS 3 category. Now X sold their land to Y on by reg.NOTARY mentioning condition that all documents to be cleared by the seller. Y has also purchased some new land existing this land so he is very much interested to purchase this land but having following doubts:
1. Can Y do sale deed based on X’s sale deed without 7/12 extract? If yes this will be a valid sale deed agreement in law?
2.How valid document of NOTARY in law& how much period if period not mentioned in while doing Notary?
3. What is the procedure to fight against tahsil dept, if Y done sale deed with X?
4.What is LEGAL document to prevent Y to sale this land to third party?
5.Is their any legal complication will arise in future?

i need passport with in a month. i already inquired in passport office about the doc i have to submit.
for the address proof, i have only ration card with me. i have pan card. but they said they wont accept pan card. and bank pass book with 6 months usage.
so is it possible for me to join in my fathers account to create a joint account and show it as a proof of address. ?and any other address proof i can submit. pls i need passport for my new company. my joining date is arriving and have no time.

GPA registration
I would request for your experts views/comments for the following situation
Situation
Co-owners (non-residents) of a property in gurgaon executed a GPA in favour of a resident indian to lease out their property and to take other steps incidental (maintenance, collection etc.) to lease in 2005. It was notarized but was never registered. The property was leased out.
HSIIDC issued a notice to the tenant and asked for lease deed which was executed through the GPA. On presenting lease deed, HSIIDC demanded for a copy of REGISTERED lease deed. Now, couple of questions
1.. Is it obligatory to get these types of GPAs registered..?
2.. If yes, Can a GPA executed in 2005 be registered now..?
3.. If not, Can the co-owners execute a new GPA? What would be the process and will it effect the lease deed executed through the old GPA..?
4.. Also, Gurgaon SRO has a view that a GPA can be executed in favour of a blood relative. I understand it is not correct. Is their any notification/circular which proves my understanding..??
