Heir missing in prior document

Sir,
I have purchased a plot from a person named Monish on 2007 in Kerala, he in turn had purchased this plot from a lady on 1996. On 1993, this plot was one amoung the six pieces of an ancestrial property divided by heirs.
During that time, in Partition document of 1993, there were seven heirs mentioned and following was written about one heir:-

"Balan left country very long time before and is treated as dead, hence his share divided amoung brothers and sisters"...

There is no document supporting the above statement availble anywhere.

Now I want to sell this plot and buyer is pointing out this as a serious problem.

Please advice me how can I solve this problem legally..?

Rent not paid by tenant

I HAVE A BUNGALOW IN AURANGABAD, MAHARASHTRA
WHICH I HAVE FILED FOR GUNTHEWARI IN 2011 AND HAS BEEN REGULARIZED. I AM ALSO PAYING THE TAX ALSO SINCE TWO YEARS. SOME LOCAL REAL ESTATE AGENT TOLD ME THAT IT IS POSSIBLE THAT YOUR HOUSE WILL BE DEMOLISHED IN FUTURE. I AM FEELING RESTLESSNESS SINCE THAT TIME. Nec (non-encumberance certificate)

Hi, can any expert provide me the format of NEC/certificate of certified copy/ inspection etc which need to be provided by the empaneled advocated of the bank?

Actually i am doing it first time... :(

As i have heard that senior advocates are not doing Inspection of the property considering it risky..is it true coz i am doing it as a new in this profession accepting work what ever i am getting,,,,am i wrong??

some one suggested me to go for RTI if inspection is not done of those documents which got registered in 1960s where records are not typed its hand written can't be read properly,,how i can do inspection of 1960s till 2013....?? very much confusing??

any guidance, advice for me :)

Issues with my sale agreement on buying a house

Hi,

I kindly request you to give a primary support on this issue & help me to proceed further.

Sorry for the long decription

Issue Description:

My Father friend was ready to sell his house,Since we are very close to him & very near by.We have planned to take his house with some money & some loan.

We made an sale agreement for 6 months & paid token advance with legal advocate support.

Then we approached bank for home loan for some amount.But the bank legal lawyer denied the loan saying some issues with title deed,Loan cannot be given. But he said,only loan is not possible,You we can still register the property if we wish wit your money.No issues will be there.

We tried so many banks,Same reply.

Since the seller was very close to our family We believed him a lot.He also agreed to register the house for us if we pay the total money.

Since we don't want risk in these documents,We said no & asked our token advance back.

He was not able to give immediately,hence we had given 6 months time as per his request since he is our friend & still believed him

Now he is saying he will not give that money back & playing a lot with us.

The only thing we have now is the sale agreement.

Hence we have seeked Advocate support & send notices thrice to him to come & register the house or give the money back.

Yet to get the reply from him.

Questions:

Now my questions are

1.How can I deal with this issue now?

2.Can I go to court with the agreement? how long it will be taking to come to conclusion.

3.Incase if he says,Register the house in the court,Can we register it since because we are getting the property directly from court.Can we say it is legal now with no documents issues in this property?

4.Once we get the property from court.Can we get the home loan support because we are lending some money from our neighbours to buy this incase if it turns like that.

Legal hire certificate & succession certificate

I am from Kochi, Kerala....My Freind's husband was deseased on Aug 2013."They are Christians".He has a Bank Account with SBI having balance more than 2 Lks,but no nominee.Also some insurance with Kotak Mahendra,nominee is his Mother,but wife not willing to transfer insurance amount to mother's a/c,so wife give 'STAY' against transfer.They have a daughter having only 4 months age. His Mother alive, but Father was died on Nov 2012.Wife doesnot wish to transfer any amount to her Mother-in Law,so pls advice How Wife trfr the said amount to her avccount? Also pls advice whatever legal/necessary certificates /documents should she keep for further purpose like sharing Property,Daughter's education, financial help from govt as a widow etc...Pls advice .Also what is a succession certificate? how th same will get ?
