Blackberry / On Call Support

Hello All,

Our company is into IT and Services. The nature of the job demands providing Blackberry phone and Laptop to some of the Employees.
Our office has provided Blackberry a Laptop to the employees whose role demands it.

Recently one of the employees lost the two year old blackberry phone in the bus queue.
The company has asked for the penalty and the penalty has been calculated at 15% depreciation which amounts to a around RS 18,000. the current price of the new blackberry in the market is much lesser than the penalty asked for 2 yr old blackberry.

The employees do not get any bonus for such 24 hours support. Also it is made compulsory for certain employees to carry the laptop and blackberry.

My query is related to what are the laws that are there for 24 X 7 on call IT support. Also are penalties for loss of equipment provided by the company justified ??

How are the depreciation for Blackberry calculated.

Instead of paying any penalty, tell the Administration that you will replace the blackberry instrument. They cannot have any objection to the same. You can also obtain the replacement sim card for the same number. It should meet the situation.

About 24 X 7 on call IT support, only the conditions stipulated in your letter of appointment/ offer letter or the agreement as may have been entered in to with the company by you at the time of your recruitment can guide you.

However, about the penalty and replacement of the Blackberry, I endorse the advice of Mr. Ramachandran.

In fact, such type of gadgets should be accepted by the employee only after ascertaining the terms and conditions of the company and satisfaction of the employee.

Thanks for the Quick responses.
Just wanted to clarify a few things. That 24 X 7 on call IT support was not mentioned in the offer letter.

Blackberry and Laptops are provided by the company for all whose role / project demands it and employees have no option but to take them. Many of us have raised the concerns of not wanting to take them and alternatives that could serve the same purpose.

Also Company is fine with a replacement, but the replacement in the market is also worth around Rs 12,000

You are stuck in very confusing position. It is a matter to fight but here you are fighting against your employer, so not advisable to say anything. Bear your position and learn for future that any facility provided is nothing but big responsiblity for you.
