An urgent query

Querist : Anonymous (Querist) 09 February 2011 This query is : Resolved
Hello everybody ! Recently I appeared for my entrance exam for admission to post graduation studies under West Bengal Health Services. My exam went very well but on declaration of the results I find myself to have been unsuccessful. Now, I want to see my evaluation sheet or my exam paper.
My humble questions are : Am I entitled to see my evaluated answer sheet ? If yes, how should I proceed ? Can any remedy be found at the H.C ? Please give some supporting case laws in this regard .
With My Regards,
Arvind Singh Chauhan (Expert) 09 February 2011
Ask copies of your evaluated answer sheet under RTI. Or you may file a writ for such direction.

I agree with Mr.Arvind.

Sir, As the answer sheet is an OMR sheet and not a "manuscript" (i.e written in own hand writing)...will it be considered as "information" under RTI ?

Further, as far as my knowledge goes, SC has passed an iterim stay order on disclosure of evaluation sheet in the case of University of Calcutta V Pritam Rooz in 2009 .
However, only model answer key can be obtained as was decided by Delhi HC in UPSC V CIC in 2007.

Please enlighten me if and where I am wrong..

Best Regards,

One more pertinent thing to be mentioned here is that the Information Brochure of the institute / university conducting this entrance exam clearly mentions in a clause that there is no provision for rechecking or re-evaluation of answer sheet and no query in this regard shall be entertained..
