(Querist) 17 June 2008 This query is : Resolved
what is adverse possession? what is/are bad effects of this? how long it takes to get repossession of a ownership appartment given on oral lease but leasee not paying rent &refusing to vacate beyond agreed period?
Guest (Expert) 17 June 2008
Adverse possession is a possession wherein any party other than the lawful owner is in possession, adverse to the title and interest of the lawful owner.

Lawful owner should have the knowledge of the possession and should keep quiet to give an advers pssession to the occupant of the property.

If it is oral lease, you can vacate the premises with police help.

Repossession is possible in court after you fail to evict him. It depends on the other facts. Please throw more light to explain further.

Period of limitation for taking recouse is upto twelve years. The same incase of government property thirty years. After this limitation the party who is inadverse possession gets legal possession in respect of the prperty.
