If he is workman then he can claim workmen compensation as per law. Such petition will lie before the labour commissioner of the appropriate district/state.

Please go through Workmen's Compensation Act 1923 and then ask specific questions. Normally If a workman injured or died due to an accident arose during the course of employment and out of employment, he (in case of injury) or his dependents(in case of death) are entitled to get compensation from the employer, if the workmen comes under the difinition of workmen as per Act. The compensation is paid through the Commissioner for workmen's compensation commissioner. The employer has to deposit the compensation within thirty days of the injury/death. If he does not deposit he is liable to pay interest. The case for claim can be filed before the commissioner for workmen's compensation. Normally Labour commissioner, Additional Labour commissioenr, Deputy Labour Commissioenr and Assistant Labour Commissioners have been notified as Commissioner for workmen's compensation. But it varies from state to sate.
