498a closure

Querist : Anonymous (Querist) 21 October 2010 This query is : Resolved
Experts, please provide step by step procedure to close 498a booked in may2010. Wife wants to reconcile.
How many days it would take to close?(approximately)
Devajyoti Barman (Expert) 21 October 2010
Since the case is non compoundable one, the Magistrate could not close the same. You will either have to let the de facto complainant and other witnesses deposed so that trial gets completed. Or else you have to file a petition for quashing in the high court.

Thanks Mr Barman,

498a is non compoundable ,
1) Certain cases in some PS are closed
stating 'Referred as Lack of evidence' or 'Referred as mistake of facts' etc.

2) Some say that she has to wait for the time of providing testimony and during the witness proceedings, inform the court that filing 498a was a mistake on her part, and make an appeal to close it.

Do we agree both are possible and legal?
Devajyoti Barman (Expert) 24 October 2010
1. That is called Final Report.
2. Yes.
Both are legal and valid but you could also o fro quashing.

I concur.
