498 a counter case

Querist : Anonymous (Querist) 25 June 2022 This query is : Resolved
498A IPC is filed by my daughter in law against me. I have no relationship with my daughter in law since last 8 years.
In Chargesheet there is no allegation against me but I am accused. No witness stated anything against me.Trial is not started. My daughter in law is residing at distance place. I am a senior citizen.

Can I file a counter case in my local court ?
Will court punish her and under what section ?

Quick Summary
A senior citizen is seeking advice on filing a counter case against their daughter-in-law regarding a 498A IPC charge, despite having no relationship for eight years and no direct allegations in the chargesheet. The discussion highlights that this platform is for legal remedies, not revenge, and suggests exploring options like filing a petition under Section 482 CrPC with the High Court to quash the FIR, rather than focusing on punishing the daughter-in-law.

What sort of counter case is intended to be registered against your daughter-in-law ?

Why do you not file a petition under section 482 Cr PC read with Article 227 of the Constitution of India before High Court for quashing the FIR against you in the given circumstances ?

When there is no evidence against you, wait for the judgment of Trial Court, you will automatically be acquitted.
