279,338 ipc

My client is on police bail. DAR has been filed in the MACT court. For the FIR filed in 279,338 IPC, the C.S. still has not been filed for over 5 months. Should I apply for Regular Bail now or should wait for the C.S. to be filed ?

After receipt of the summons you can file for regular bail.

Your client is already on police bail. Both the offence are bailable. When the CS is filed, summons will be issued and then your client has to appear before the court and apply for bail u/s 436 cr.p.c.
