15 days calculation.

Querist : Anonymous (Querist) 23 June 2011 This query is : Resolved
Whether a person, against whom more than one cases are pending investigation in same Police Station, can claim at the time of his arrest in one of such case that he should be simultaneously arrested in all cases pending against him so that the total period of his police custody remand may not exceed 15 days in all ? SO how 15 days will be calculated. It may arrest the accused in respect of one case even after order of bail in another case. ?

The arrested person cannot ask that he be arrested in other cases as well. Yes, the police will, if they feel it necessary, arrest the person on another pending case, after order of bail has been granted in the first case in which he was arrested.

sir thanks

sir so if the though in the first case the bail has been granted but the second offence is include in the chargesheet than the police has the powers to arrest that person in the second offence only. IF the accused doesn't want to arrest in the second case then the acccused has to again file the bail petition in the court for the second offence which has been added. Second time bail petition for the same accused but in difference offence in the same chargesheet.

Thanks.
