recovery of cell phone in jail

Dear Experts
This is my subsequent query because previous answer was illusive.Whether recovery of cell phone from a prisoner is contravention of sec 120 A of the IPC and punishable U/s 120 b(2) of the IPC or not? please opine

No it is not in contravention of sec 120A.

Recovery of cell phone if under offence under section 120A got recovered be treated as evidence and offence under 120B is punishable. But if otherwise the cell is recovered in general circumstances it will not be treated under 120A
