unregistered lease for 99 year with sum of Rs 3 lakh .

Hi good morning,

we are having this shop from last 41 year with 99 year lease which is unregistered and there are two witness in that 1 is still alive.It is clearly mention that landlord heirs and tenant heirs will follow this for next 99 year.Now he show bonafied need to get this shop however he gave wrong information to court he was working at good package 12pa .we put this lease in lower court in 2011Jan -2014may he never challenge this till now he want us vacate shop what can we do .Can he challenge lease now after 5 years

Dear Mr. H. S. Khurana,

1. The time period of 41 years of being in occupation of the shop will stop the original landlord's legal heirs from disproving the existence of a written contract ( through it may have not been registered) in the court of law and hence the court would not pass any order for eviction against you and so you should not vacate the shop premises at all.
