This question relates to a Bank. An officer was suspended based on a complaint regarding unauthorised transactions in the account of the complainant. No opprortunity was given to the officer to explain his position. A preliminary enquiry was conducted by the manager and a report was sent to the controlling office. Should not an opportunity be given for explaining before ordering a suspension ?

Suspension is not a punishment so there is no need of providing opportunity of hearing if disciplinary authority reaches to a conclusion by way of preliminary enquiry that a prima-facie matter pertains against delinquent employee.

Suspension is merely a preliminary activity of the management to prohibit an employee to transact any business of the organisation before conduct of disciplinary proceedings against the employee. This is just to avoid him from tampering of the proof, if any, against him. The period of suspension whether to treat that duty or otherwise solely depends upon the outcome of the domestic inquiry after serving the employee with a charge sheet or trying in a court of law, if the case is of criminal nature, and to give him adequate opportunity to defend himself against the charge.
