Status of criminal complaint after summoning order set aside

(Querist) 19 May 2014 This query is : Resolved 
In a Criminal Revision Petition, the court of ADJ set aside the Summoning Order of the lower court. The other party says that it will now carry on with the criminal complaint in the lower court. Can they do so. The judge of the lower Court has asked both parties to submit relevant law. Please help. I am attaching copy of the order of the ADJ.

Issuance summons it self is set aside, so complaint is not maintainable.
