Required advice for initiating legal action

i, Nilesh Mishra, working as officer (legal) in a private limited company. recently one of our employee who was appointed as the master of the ship had send message that he will not sail out the ship from USA unless his date of signed off has been communicated to him. As per the terms and conditions his contract will be terminated on 06/05/2012. When we pointed out this terms and conditions this crew he became more annoyed and has stopped working.

Dear member kinldy advice what sought of action can we initiate against this crew
specially criminal action.
