Occupant with-holding speedpost addressed to NR-Landlord

Speed Post containing valuable documents including blank negotiable instruments or even ordinary mail, addressed to non-resident Landlord, received by unauthorised Occupant, neither being passed on to the addressee nor returned to the sender, how can such illegal acts of the occupant be booked by local Police and what is the remedy for the hapless landlord

He may be penalized under Sec 419 IPC. Lodge the FIR or collect the information from concerned post office about delivery slip then file complaint before court with this slip.

After filing of a complaint with local Police under sections 68 and 69 of the Indian Post Office Act, 1898, if the accused returns the Speed Postal Article, would that save him from the offence already committed on 25.10.2010 when the Postman delivered the article, addressed to the landlord, to the occupant who was in no mood to forward the article to the real addressee ?

Can the delivery agent of the speed post held liable for wrongful disposal/delivery to the non-addressee? If so, under which provisions of law?

Sections 68 and 69 of The Indian Post Office Act, 1898 provides for upto two years / six months of imprisonment for (68)"whoever" retains or willfully secretes or makes away with or keeps or detains any postal article in course of transmission of post which ought to have been delivered to any other person / (69) "whoever" willfully and maliciously with intent to injure any person, either opens or causes to be opened any letter or does any act to prevent or impede due delivery of a letter. Section 70 provides penalty for abetting offences under the Act. Is the Police duty bound to book FIR against such accused and which sections of IPC would be invokable ?
