Non-implementation of Gazetted Holiday

(Querist) 03 April 2009 This query is : Resolved
Can a pvt charitably funded educational institution remain open and conduct classes on a gazetted holiday in the beginning of session? What is the meaning of gazetted holiday ? Is it not a violation of fundamental rights of students ? How to proceed so that the defiant Principal and its officials are punished ? What all essential evidences have to be gathered to prove the same operation ?

What is kind of institution, is it a government institute or private or self proclaimed. Lot depends on this. If not government or government funded, it has nothing to do with gazzette.

What is Fundamental Right of students which is violated? It is for the welfare of student. If you are a teacher then you might be an affected party. If that is the case look into Mr. Prabhakar advice.

I agree with all the larned members. There is no violation of fundamental rights. And pvt., funding charitable insitution is not bound by gazetted holidays. Gazetted holidays means declared by the govt and published in the gazette, I think I am right.

Even if there is a violation of Fundamental Rights of students, its a good thing !!. After all the only consequence is that the students will study more !!!
Infact India is almost always on some holiday which results in fewer working days and that means excessice wasteage of man hours.
Rajneesh Malhotra (Expert) 05 April 2009
Mr.Oberoi,
Instead of filng a case to ask them to stop working, you should be filing a petition to force the govenment to give them some award !!
Sachin Bhatia (Expert) 02 October 2009
There is no violation of fundamental rights.
