Querist : Anonymous (Querist) 20 March 2011 This query is : Resolved
Hi

can multiple fir be file in different state for same allegation.
498a file in kerala can it be filed again in my present state.
Got one AB in kerala would it help in case file in delhi.
prashant pundhir (Expert) 20 March 2011
Multiple fir in the same crime can not be lodged . Definetly if the language of both of the fir's is different,it will help you lot. The malafied intention of the complainent is also clear that he want to do your mentally harashment .So it is in your favour .

then why do see multiple case file against husband, 498a, dv, 406, will content is same.
Kirti Kar Tripathi (Expert) 20 March 2011
Because most of the facts in all case related with same parties are same but certainly main cause of actions shall be different.

you question is that whether the other proceedings like the DV Act and 125
Cr.p.c are initiated against the husband then it is yes because these all are different.
Devajyoti Barman (Expert) 20 March 2011
It papers that you want to say that on the basis of same facts of case how different proceedings u/s 125 crpc, DV Act, U/S498A IPC etc.
Here the different cases under different provisions of law is filed which is very much permissible and not different FIR on the same 498A case is filed.

is it possible to request court/police to combine all case into one. so wont require multiple hearing at different count
Sarvesh Kumar Sharma Advocate (Expert) 21 March 2011
no,
in the same sinario two cases can't be file!
take certify copy of one case and filed it to another court!
see the ingrident in the 2nd case .
if first case story is not discribe then
chance to file a criminal case against them!
Devajyoti Barman (Expert) 21 March 2011
No, since proceedings are under different and under provisions of law your wish can not legally sustainable.
