can a divisional manager transfer a employee and stop work of a worker send him to another division another state ( which is not in his divison or juridistiction ) appointment authority of the worker was the head office management.
R.Ramachandran (Expert) 08 October 2011
Yes. He can do so, so long as the Management supports his actions. If at all, it is only the management which can object to his actions and not anybody else.
Raj Kumar Makkad (Expert) 08 October 2011
It depends upon the power given to such divisional manager by management. If power is with him then his action is legal otherwise illegal and even employee can also raise his objection if his action of tranfer was beyond his power.

In view of two opinions your prob should now turn that can such a want of authority can be rectified by subsequent confirmation by the management??????
Vijayarajan (Expert) 08 October 2011
This is a question of delegation of authority on the dvl manager who has done this.
Sailesh Kumar Shah (Expert) 08 October 2011
Yes, He can do so provided he is authorise to do so or later management ratify the same.

Your question seems to be devoid of facts, as unless the divisional manager would have been vested with powers to transfer the worker outside his jurisdiction, it would not have been possible for him to transfer him to other division, or else the transfer would have been made only by the competent authority of the organisation.

So, you need to verify the facts of the case.
