ON THE ADVICE OF "A", a boy 15 years by name "B" put poison in milk and supplied to "C" and after consuming it. C died. Decide, how to prosecute "A" and "B".

pl give reference case law and boy 15 years (minor conditions) Pl give rerence.

both should be prosecuted u/s 302/120B IPC.May be they are minor but at the age of 15 they were much aware of the consequences.they should face trial in juvenile court.

Both will be prosecuted for offences u/s 302,120B,34 of IPC but as 'B' is minor his trial will proceed in accordance with the JJ Act and 'A's trial will proceed in normal course because from your querry he seems to be major.
