HUF PROPERTY

(Querist) 26 June 2011 This query is : Resolved
MY FATHER HAD THROWN HIS PROPERTY INTO COMMON HOTCHPOTCH OF HUF. NOW THE MATTER IS IN THE COURT, BY WHAT DOCUMENTS CAN I PROVE THAT THE PROPERTY WAS AN HUF.
R.Ramachandran (Expert) 26 June 2011
The same documents on the basis of which you claim that your father threw his personal property into the common hotpotch. And other documents which you believe proves your point.

I just have a wealth tax copy in which it is written that the property is HUF. Will that be enough?
R.Ramachandran (Expert) 26 June 2011
Whether it is enough or not the court will decide. That is what you have now and you have to file your case and see the result. During the course of the case something more may emerge from the other side also. So whether your document itself is sufficient/enough would depend upon what other documents that get produced to rebut your claim.
jatinder (Querist) 26 June 2011
Mr. Ramchandran isnt that an obvious thing that court will decide that, but my question is will it be a proof or not. I will be obliged that if someone has lack of knowledge regarding this then please dont comment and misguide.
R.Ramachandran (Expert) 26 June 2011
Dear Mr. Jatinder,
You did not ask whether it is a proof or not. Rather you asked whether it is "enough"?
So, the obvious answer is while it is a proof, but whether it is enough or not will be decided only by the court, especially keeping in view whether any other documents are being produced to counter your claim.
If there are any other views to your query, let the other experts in the Forum guide you.
I do not think that I have misguided you. Just because the answer may not suit your requirements, does not mean the one who is answering is lacking in knowledge or misguiding you.
I only answered your specific question in a straight manner. If the answer does not suit you, you have every right to ignore it, and that goes without saying.
