Hi,

I am ragu, from chrompet.No i am staying in the rental, house(flat) for which i am paying 3800 as monthly rent(from April 2007-feb 2008). Now they suddenly raised it to 6000. my house owner is a greedy person. i want to know, what is actualy the leagal way of rent calculation. on what basis our Indian/Tamilnadu law says for rent calculation.on what basis a landlord should fix the rent amount and hike the rent per year.
is there any site to down load the document? please suggest me how to face this problem legaly. i am paying rent thro' bank transaction.i put aggreement for the above specified duration (year).

Mr. Raghu,

The Hike in rent isbased on twothings one by wayof agreement and other is on the basis of prevailing market value in andhra pradesh there is a provision in RentAct i.e. Section 4 as per the same the rent will be enhanced by thecourt basing on the prevailing market value ofthe rent in the area you are staying,

You also can approach the court to fix the fair rent if you feel the rent is excessive more than the prevailing rental value in the market.

Fix the fair rent through the rent controller. Who is the rent controller you check up locally.

Contact the local lawyer for exact advise, as the rent laws vary from state to state.

You can very well file an R.C.O.P - for fixing a fair rent for the premises.

Fair rent will be calculated by the basis of Market value of the property. It can be fixed by evidence of a Qualified engineer after visiting your place with the permission of the Court. Your Jurisdiction will be Tambaram, I suppose.

Under Section 4 of Tamilnadu Buildings( Lease and Rent Control) Act, 1955, you can initiate proceedings against your landlord
