My mother was a french citizen till her death but stayed in india ever since her marriage to a muslim but payed her stay tax every year

what/where is the question? hiba nama means a gift deed.

my mother was a french citizen till her death.In the early 1950's she came to india and married my muslim father.She did not convert to islam and continued to pay tax to stay in india and continued to be a citizen of france.In her lifetime she recieved some money from france and bought property.Before her death she executed a hiba in the name of my brother.My question is that being a french by birth and a citizen of france,is the hiba nama legal ie can she execute a hiba being a french.

It seems the case has become a controvercial one when hibanama has been made under Islamic Law by a non-Islamic lady.
