Fir through court

Querist : Anonymous (Querist) 25 September 2025 This query is : Resolved
I am a layman. Can I file an application under Section 175 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, against someone? (I took all steps which are required).
I paid an advance fee to one advocate, but he has neither submitted my application nor returned my money, 1 month went away. Therefore, I have decided to file it myself. Kindly provide me format of section 175

T. Kalaiselvan, Advocate (Expert) 26 September 2025
Section 175 of the Bhartiya Nagrik Suraksha Sanhita (BNSS) 2023 deals with the power of a police officer to investigate cognizable offenses, with a significant addition being the mandatory requirement for a complainant's affidavit and a Magistrate's preliminary inquiry and hearing of the police officer before ordering an investigation, especially in cases against public servants.
What is your problem, please revert at least with minimum details if you want any legal opinion.

Can I represent myself in my own case under Section 175?
matter is related to theft and extortion
T. Kalaiselvan, Advocate (Expert) 27 September 2025
You can appear as a party in person before court in your own case.
P. Venu (Expert) 27 September 2025
You can. However, the petition and affidavit needs to be properly drafted. If possible, you may avail the assistance of an advocate-clerk.

There is no legal infirmity if you are proceeding your case as party in-person.
